Question about the misuse of drugs act.

I picked up my car yesterday and picked my mate up pretty late on to go for a wee drive. A couple of minutes in I get pulled because he looked like he was hiding something in the back(was looking at cds or something).

I check out all good and thankfully everything was fine with the car but my mate had 2 joints on him. He was arrested under the misuse of drugs act and was told about how he coudln't get into Australia now?:confused:

Anyway he wasn't taken down the station and I was sat in my car whilst he was in theres so don't know what was said exactly.

He wasn't fined and wasn't given anything to take away with him but he seems to think he'll end up in court?

What is most likely going to him?

All in all I'm pretty peed off at him since now I'll get pulled because of his fails.
 
Nothing will happen to him, sux though cause you're car will have a "drug" marker on it now.

I forget but I think there is a 3 strike "rule" for cannabis, especially for such low quantities.
 
Exactly why I'm not amused. I'll be in and out the city a lot and can imagine it'll be a lot of fun getting the car searched lots.

If he wasn't fined he'd have to be charged with it at the station, is that right?
 
After some reading, if he didn't get given a bit of paper then it sounds like it will be recorded locally as a warning and not on the PNC.

He wouldn't get charged for 2 joints.

i am a police officer so i can answer this for you...

number one, TUT TUT on you for letting your mate in the car with you when he had cannabis on him....

where do you live?. with my police force, if they don't have pervious for dugs we will issue a street caution and take the drugs away from that person!, thats depending on how much that had on them, if it's more then personal use that person will be arrested! for the suspected dealing, as you say "2 joints" on him i would not class that as dealing but as personal use.

So i take it your friend has have pervious in the past?. that could stop him from getting in to Australia..

When he was in the station they would have told him what is going to happen to him! FACT!!!.

As you being the driver there will now be a Intelligence report about your car, so next time the police pull you over there will be markers saying known for having drugs in the car..

Can't believe he got lifted for a couple of spliffs, all that's ever happened to me was the weed getting 'confiscated', first time I got a warning letter and then I got a couple of fines, never got lifted.

I don't believe this "drug marker" rubbish either, I was pulled over a year ago and my mate was caught with a bit of hash and I have been pulled over once for something completely unrelated since and there was no search or any of the stuff you would expect.
 
He has no previous at all. I don't intend to search all of my mates that get in my car but it's the last time now. I liked the fact I could know I was all good with insurance,tax,mot and that I don't smoke the stuff.

He was never taken to the station only in the back of the car with them.

He probably just got a typical "weed is a gateway drug to smack" bollocking then, 2 joints is nothing, I would have expect a decent copper to let you away with that if it was obvious it wasn't being smoked in the motor. If you don't smoke the stuff yourself, especially in your car, I wouldn't worry at all about getting pulled or singled out for this 1 incident.

They weren't being smoked in the car and he had said to them we were on our way to my house to smoke them even though we weren't.

I think they thought he was carrying more because he was apparently stinking of it as he must have smoked before coming out. Can't say he smelt of it tbh though.

Lets not have a drugs debate ;) as we all know the classification isn't really based on harm/addiction.
