Question on 3month warrenty on car bought from independent garage

Hi guys,

Looking for a bit of advice again if anyone is able to help.

My girlfriend bought an 06 plate astra sport hatch on Wednesday, yesterday after only 3 days of ownership we noticed that the 2 front tyres were illegal and needed replacing as a matter of urgency.

We replaced them with 2 Goodyear tyres and the tracking was also out, all this came to £190.

Are we entitled to have this money reimbursed by the garage we bought the car from? She’s only had it 3 days and done less than 200miles including the 100mile journey back from the garage in Yorkshire.

If anyone can point me to any particular clauses in trade’s description act or what not that I can use to point to the garage it would be appreciated.

The old tyres were disposed of by the garage that fitted the new tyres so unfortunately we don’t have them, we do however have the invoice for the replacement tyres.

Did you not check the tyres when you got it??? I would have a full check of the car tbh - How many miles has it done???

what he said.....surely you checked the car before buying it?

a franchise dealer would most likely have replaced the tyres as part of their checks.

Maybe worth looking at the independant's sales pitch to see if they offer an xxx point check.

The honda garage i got my ctr from kept on about the 100 odd point check they do.

either way, you should have gone to the garage before buying them.

Nothing under the warranty is likey to cover that. Your best bet would be to go under the sales of goods act as the car not being fit for purpose (assuming the tyres were actually illegally low/damaged)
 
her old man said they tyres were low but didnt realise they were so low, i think theyd worn illegeally on the inside edge due to the tracking being out but still had a little grip on the outside. the car has done 21k so front tyres should have been replaced already at somepoint i would have thought.

Cant you return a car to a garage within x amount of days if you decide you dont like it or is that urban myth?

It's an urban myth, you have no right to return anything (unless bought via distance selling such as the net or over the phone) just because you don't like it.
 
tbh i dont think you have a chance at getting the money back, you should have checked all 4 tyres before buying, only when you point out faults will dealers put them right (before buying). thats from my experience any way
 
You should have checked the car over before taking it, failing that you should have gone to the dealer to get them to do it. Most of them have agreements with local tyre shops to do this sort of work.
 
well, will give it a try anyway as in all honesty i still think its discusting that a £10k car has come with illegal tyres and knackered tracking.

Neither the gf or her old man are mechanically minded, so are not able to offer an expert opinion.


whether we get anything back...i dont know, but we have nothing to loose.

well i did tell her the contact the garage she bought the car from first, but shes female and knows best, im just gonna keep out of it lol
