Question ref sales of goods act

So Sainburys actively go out of their way to ignore the SoGA. Awesome.

Ok just found a recentish leaflet and the part i was refering to is this

"Medion, All laptops and all games console product have a 28 day guarantee

Please contact the manufacturer directly after the time"

I think this was either what it changed to or from with is the last 6 month because i dealt with a customer trying to get a refund or replacement on a 3 1/2 year old TV!!!

But i haven't worked on that department for a while now so things might have changed again.

I think JS also started to to accept returns for refund without a receipt as well so if the OP asked for this then again not the Sale's Monkey's fault

Erm, the sale of good act states otherwise (assuming it is a consumer purchase and not a B2B transaction) :)

Keep the leaflet though - Trading standards would be very interested in that.

I think most stores would be referring him the manufacturer as the unit would normally have a one year manufacturers limited warranty to fix the hardware, with certain limitations obviously such as him dropping it.
The warranty and the SoGA are two seperate items and run along side each other.
 
Pretty sure SoGA doesn't state 6 months. Think I just says "a reasonable time" which has often been said to be 6 months. However, I think Amazon only give you three months, and I doubt someone that big would be chancing their arm too much.
 
Just checked opsi - it is 6 months. Maybe I read old legislation last time we had this discussion! I'll check amazon's terms, too, as I'm currently dealing with them over a dodgy Netbook.

Anyway. Sainsbury's are free to tell your friend that he has to contact the manufacturer. They don't want to deal with returns. However, it's his statutory right to require them to deal with it themselves. Shops get away with this because shoppers don't know their rights, and it isn't the shops business to explain a shopper's rights to them. That's why they always make the point that your statutory rights are not affected. Most people just don't know what those rights are.

Holy cow man, Tesco never learns, I think tesco is probably the super market most taken to Court on the planet, they are either really ***** or their staff is retarded.
 
Right here is what will happen. You either ring said manufacturer yourself and arrange a collection from your home or take it to where you bought it and they can do it for you instead. They will not however refund the item in store it will be sent away no matter what.

edit. p.s worked in a certain electrical store and had this issue raised so many times its unreal. :(

I find that people like to take it back to the store as they think they can a have a refund and buy something else or they think it will get swapped out there and then.

Then why is it that the stores, even when presented with the required legislation point at their in store policy signs and claim that is that?

I had this problem with an iPad not holding it's charge bought from the purple shirts. Bloke had it in over night to "test" and failed to replicate the problem (I'm not convinced they tried) and all he kept saying was that I could return it within 28 days for a refund if it was unopened. As far as he is concerned it's ok! , no refund / swap / replacement. The SOGA also provides that "fit for purpose" is in my opinion, not the stores.

I still have the faulty device right now :(
 
Sorry I should have made myself more clear if the same product is still available I see no reason why the store can't do a striaght replacement there an then, being only 3 months old I guess there is a small chance that the same model might still be current.

They wont do the straight swap because the shop will take the hit rather than the manufactuerer. I know it sounds lame but where almost like the 3rd party between yourself and the manufacturer.

Sorry to hear about this. Where I work we are pretty good with stuff like this. Same place infact only part time while im at uni. For the store to send it away they do have to see the fault, battery fault is a tricky one unlike a diag test for example. Best bet here would be to go directly to an apple store of get in contact with them over the phone. Apple is a bugger in relation to guarantee too unlike other brands.
