Received a "Notice of Distress Warrant" wrongly!!!?

Bailiffs can't take anything from anyone who isn't the person they are collecting the debt from right? so in that case they legally can't touch your stuff, not that you should let them in but if in a lapse of brain function you do, show them ID, a bill with your name on, tell them this person doesn't live there and you're fine.

For the OP, I had a similar issue to you (apart from threats like that). I simply posted any letters back with "No one by that name at this address" on them. I also had to phone several companies to remove my address from their records as they were seeking payment from some bint who used to live here before me.

Remain calm, phone the companies - if you want to get rid of them you may have to send proof of you living there. If not a council bill then a tenancy agreement or other bill?
 
your screwed if they have a warrant - they can just push you out of the way without a care in the world.

You need to call the courts/baliffs asap and figure out how and why the warrant was issued and on what grounds. Your on the electrol role surely? if your not then thats pretty much obvious as to why they presume mr joe bloggs still lives there -
 
Give your local mp a ring. I'd be worried if the first I heard of debt collectors coming was them flashing a warrent in your face. I don't see how it got that far without them bothering to find out who lives in your house.
 
Use the standard defence against home invasion, pour a mixture of bleach and acetone, ammonia or an acid into a bucket in the house entrance and seal it off, should anyone force entry into the property they will be in for a nasty surprise.

So can bailiffs break in if they have to?

Depends on who the debt is with, if it's income tax, VAT then yes indeed they can force there way in, even if the house is empty & secure, they will just use a locksmith & then bill you for it.

Any other kinda of debt, no the bailiffs can't force there way in.

I may be wrong but don't they have have to serve the warrant on the debtor before they can force entry to a property. If they turn up show them I.D and if they try anything heavy handed just call the police. They still have to obey the law and if they push or force anyone out the way they would technically be commiting assault.
 
Does anyone know if this company is legit? Phoned them and told them they have the wrong addrress. She said to send in a copy of our council tax bill to prove we are the occupants.

Dont want to be sending off stuff that can aid with identidy fraud.

The council bill doesn't proofs he does not.live at you address, it just proofed he is not registered at your address.

All you can do is let the bailiffs know in writing and leave it there, if they turn up it is costing them money, don't let them in and call the police, they can check the electoral register themselves.
 
I'm sure I heard somebody say in the thread we had the other day on Bailiffs that if they actually have a warrant, they have to serve it with Police present anyway.
 
As has been said, get onto the court ASAP and find out if a warrant has been served and which monkey did it!

Also contact the bailiff company and in no uncertain terms inform them that he does not, nor ever has to your knowledge lived there and that you will be persuing them for harrasment if they continue. Someone somewhere has dropped a huge clanger, a warrant is a very serious document and if its wrong then someone is in doo-doo!

Instruct all members of the household to only open the door to people they know, if they do not know the person at the door then do not open it... keep all windows closed.

Even though the law is on your side, if bailiffs do manage to gain entry then you will be fighting harder to get it sorted. If they appear and demand entry inform them of the situation and call the police if you feel threatened, if they have a warrant there should be police present in which case you inform them of the situation and go from there.

Best best is to get the magistrate/judge who signed the warrant to get their arse in gear and demand to see/speak to them to find out why they signed something thats wrong!
