Sale of goods act query???

Afternoon,

After many weeks of fighting to get an LCD tv replaced, the retailer has agreed to replace it. The manufacturer has confirmed it cannot be repaired and will credit the retailer the costs incurred.

My question is that under the above act is it correct I must send the faulty unit first to the retailer before a replacement can be shipped? Ideally I would like a delivery and collection to take place at the same time to avoid being without a TV for a few more weeks.

What they're doing seems perfectly fine to me.

If it's a high street store ask to swap over in store and then you wont be without it at all.

Indeed, however if you want to really take the full SOGA promise then you could claim compensation for the time without a product.

Basically you should always be left in the position you where when you purxhased the screen. X number of days without a screen is obv a worse position. BUT it would be a pittance, lets say for arguments sake you paid £500 for the screen. At average life of 5 years = (365x5)/500 = 27p per day so you could claim back 27p x how many days you are without a tv !
 
afaik the soga says that the vendor must provide replacement or warranty repair in a reasonable amount of time.
nothing specific about how the exchange takes place, esp with a standard manufacturers warranty
