Unless it's being directly and repeatedly aimed at persons to antagonise them (which arguably the twitter person arrested was doing with his responses towards people), I don't think it's a good idea to have offensive comments punishable in a criminal sense.

I think the test should be that for these comments to be actionable, an action must have been taken for the comments to be aimed directly at a group of persons and should have been intentionally confrontational, with that action taking distinctly more than the amount of effort required for any such offence to be incidental.

That would rule out facebook and twitter comments unless they were, for example, comments posted directly on victims walls or targetted malicious emails etc.

Where does maturity and common sense come into it? You would expect people with family in the armed forces to find such comments offensive. Instead of attacking the moron making such comments, you're attacking the victims for being offended? :confused:
