The problem is that things aren't settled in court. People are far less likely to lie in court.

Fair play to you but I would have taken the free £2k-£3k. I've seen how easy it is to claim for whiplash first hand as my girlfriend got a £2500 payout after a minor collision on the motorway a few years ago. I would certainly claim given the chance.

And this is why the current system needs to be changed.
