My first car, which to save posting in the 1st car thread was a rusted out white Renault Clio, was, for all intended purposes "sold". Well, I gave it to the guy who I bought my new car from (Megane Coupe awesome whatever you say).

Anyway, goin off on one there, I gave it him and as far as I know he gave it someone he knew for their daughter to practise in on a field. I'm quite sure we didnt do anythin about tellin the DVLA but they sent me a letter yesterday sayin the tax had ran out and I owe them a fine.

Now I was just gonna declare it SORN and pay the fine but you can contest it in writing, I found out the Clio had been scrapped so do I have any ground to try and challenge the fine?

Humm, and when he uses it to do hit and runs, firebomb etc etc? Not that i'm saying this bloke isn't the nicest bloke in the world, but you see what i mean? Why didnt you just tell the DVLA???

You didnt follow the procedure setdown when "selling" a vehicle. So its you fault, good luck trying to contest it! Its difficult enough to get them to own up to their own mistakes!

If it was an approved DVLA place they should have a certificate of destruction. Send this to the DVLA and you will be ok.EDiT- oops misread it as thought u said it had been scrapped.

Just pay the £40 fine and put it down to experience. You should have transfered the car over using the V5C and sent it off yourself.

I don't really see how you can contest this.
Even if you were able to prove the car has been scrapped etc what you didn't do was inform the DVLA of a change of ownership which is an offence in itself.
So even if they were to overturn your actual fine now, you would be guilty of not informing the DVLA of the change of ownership (something you'd have to admit to if you wanted to get out of the other offence) and get a fine for that instead.

Are you absolutely sure? Perhaps you did send them a letter informing them it was taken away for scrap but you've just forgotten about it ;)

Have a good look on your hard drive for the letter you wrote and forward them a copy ;)

Still doesn't work. You will have realised when you got the tax reminder...

see this is the kind of thinking people like me post on Overclockers for.

Sadly, the letter has been posted now, the fine and all.

Ah well, lesson learned. Cheers for your help.
