Spec me an Injury Lawyer

Your dad should only claim if he has suffered a financial loss or significant emotional pain, not just because he has a bit of a sore leg for a week or two or whatever.

'Getting worse' is what generally happens with injures, they stiffen up and swell while your body works at fixing it.

Accidents happen and people should really put themselves in the other persons shoes, would your dad want to be getting sued and lose his NCB if the situations were reversed?

It all boils down to how bad your Dad is tbh, which can only be decided by himself.

Also, was your dad looking the other way as the car was coming out the drive?

It is all very subjective, especially for us as we only have a smidgen of the details.

Jeez, the guy's worried about his Dad OK and obviously can't be much help at the hospital so is thinking about what he can do. I'd certainly sue someone if their negligence injured me, I defy anyone to tell me they wouldn't so stop moaning about insurance premiums as well.

@the OP - sorry I've never had need of an injury lawyer. My Dad used to do Personal Injury cases though, he was a high-street solicitor though rather than one of these advertise-on-tv type places - I got the impression he was quite good at it but obviously I'm biased. I'd wait until the full extent of your father's injuries are known then maybe consider seeing a local solicitor - you might not have to pay money up front it depends.

If you were in his fathers position (assuming he is injured) , would you make a claim?

Depends entirely on the extent of the injuries. If it was quite seroius and was likely to have medium term consequences or cause me financial loss, then probably, yes. Anything less than that and no, probably not.

If it was properly serious he'd have been admitted by now rather than still be in A&E surely? If he didnt require immediate hospital treatment then hopefully it's just bruising and a sore back for a few days :)

If you feel that it is justified to make a claim, then make a claim.
Presumably you'll only win a case like this if you can prove that the driver was at fault. If that's the case then you have a reckless/negligent/incompetent driver crashing into pedestrians. How does that not warrant a phone call to your local police station?

I have no doubt that hitting a pedestrian on a pavement is undoubtedly the drivers fault, subject to exceptional cirumstances and contributory negligence.

But yes, a phone call to the police wouldn't do any harm should you so desire.

.

Never claimed for whiplash, although other people in the car where pressured into it from the insurance company.

Absolutely no point thinking about making a claim to you are healed anyway. Seems odd to me thinking about this rather than getting better.

I'm off work atm with a broken sternum and injured back, haven't really thought about it other than everyone going I should, I'll wait till I'm fully healed first and see what there final report says, before deciding everything. Although I don;t like the idea of suing peopel for not small injuries.

Anyway hope your dads ok and concentrate on that and give him any help he needs, before thinking about any of this stuff.

So let me get this right... your dad walked away from the accident?

And while he is in h'pital you are already looking up info for a wee compo claim?

Ah lovely.

Can people just not be glad that a relative is alive and isn't seriously injured? And then people wonder why insurance goes up each year.

Seriously winds me up that.

Why would you let someone get away with causing someone you damage, no matter how minor?

The driver drove into someone yet you're blaming the injured party for insurance hikes

Yes I am - correct. In the case of a proper injury fine. When we don't even know yet that the 'injured' party in this case is even injured then that is different.

Claiming money is for loss of income or further inconvenience to ones circumstances further down the line. As far as we know that hasn't even happened.

The compo culture is sickening.
