Stolen phone :-(

I fell asleep on the bus home and 2 guys, would have been caught on CCTV on the bus ive been told undone my jacket and took my phone out of my inside pocket, ive got insuarance with vodafone direct but would they say that this is not covered as it was in a public place? ive barred the phone and t mobile sim and have a crime reference just wondering how i go about making a claim?

guess call vodafone and see what they say.

otherwise can try house insurance if you got any ?

I'd imagine you are covered. You were effectively mugged, but offered little resistance

I could see it going the other way, failure to take reasonable care to prevent the loss, he essentially left it unattended in a public place, much like leaving it on the table in a pub while you go to the bar...

Without speaking to them and going through the full details and without knowledge of the exclusion clauses it's rather hard to tell.

Hmmm, it's not as if he left the phone in the seat next to him. It was in his pocket... he was effectively pick pocketed. It wasn't left unattended since it was on his person when it was stolen!

Could he have prevented it easily? Yes, he could not have fallen asleep when it wasn't safe to do so, which would have dramatically reduced the risk of the phone being taken.

That could quite easily come under failure to take reasonable care with most mobile insurance policies, although most would allow one such claim of this nature before refusing to cover any more....

Can you tell I actually dealt with lost and stolen insurance claims for a year or so...

cheers guys, ive reported it and they had no details of the phone so ive gotta take my n80 box in and they have already told me the n80 isnt avaliable anymore lol

ps i went to xfms winder wonderland last night at brixton so cheered me up big time!!!!!!
