Stupid friend of friend driving over the limit, need to vent.

So if you felt so insistently that she wasn't fit to drive....why did you let her? Is she not a real friend? Did you think she'd be okay on her lonesome in the car rather than carrying passengers?

Just want to try and understand the thought process that brought on this mini-rant here. Either you thought your friend was fine to drive, in which case you're a **** for starting an argument over nothing....or you thought she was unfit to drive, and you're a **** for not stopping her.

I don't believe aribritary limits make you safe, I would have judged her ability to drive and made my own decision to accept a lift or not from there.

If she gets stopped though are you i nany way liable or anything being a passenger?

As the passengers in drink driving killings always seem to be charged with something.

This was over a 3-4 hour period. She was definitely drinking alcohol - I know because I tried some.

So not condoning her actions, but at what point is it OK to get into the car OP? If she had one pint, would you have done so?

Still not OK, depending on how long it was between that one pint and driving.

Like I said earlier, I regret not doing anything about it but I felt powerless. I had a word with her earlier though, I hope she's not stupid enough to do anything like that again.

I was involved in a car crash with some friends (drinking) we did make the driver feel guilty as he didn't realise he could have killed us or even crippled us, lucky it was only minor injuries in the end. The Christmas after that i was drinking with my Polish cousin and at the end of the night he wanted to drive the few miles home, this really annoyed me so i decided to walk after having an arguement with him.

Living on the limits might be ok for some but when you have passengers you have to be responsible for their safety.

Still not OK,.

so probably under the limit then.
Why is it not ok? As long as shes under the limit. Which she could well be. Ever drove tiered, everyone does and thats morr of a risk than being under the limit, or drove ill or on cold medication. Everything is a risk it's about keeping it to a resonable limit hence the law.

I don't believe in shopping people - if they're going to drive, they're doing to drive, no matter what I do.

I just won't get in the car with them, and I let them know how idiotic I feel they're being.

2 pints + 1 unknown drink over 3 - 4 hours will be under the limit, unless the unknown drink was something ridiculously strong/large. Sounds like she was OK to drive and there was no real issue.

what i was thinking

and is someone who is borderline over the limit more dangerous driving alone or more dangerous with 2 passengers

AFAIK, no.

However, if you do get into a drunk driver's car knowing that the driver is drunk and the car crashes, you can still sue the drunk driver for damages. Knowledge of the risk is not consent to the harm.

contrary to what others are saying, i think that passengers can be charged depending on the seriousnes of the crime. i believe the law can apply the broad spectrum 'guilt by association' ruling.

I just find it funny how the OP complains about drink drivers and that his "cousin" was killed by one... Yet he still lets his "friend" or "friend of a friend" drive home knowing that there could be consequences.
