Wouldnt it be more incompetant to provide a service level based on the first day usage when its been spammed across every news site, rather than what its normal usage will be?

The problem is it's going to be spammed for weeks to come, meaning that for the next month it probably won't be working due to the miscalculation in demand. It's always better to have too many resources than too few.

Depends how much of a cheapskate they want to be and how much they care about the poor reputation the site going down can give them. The company I work for aims for their web servers to only be running at a few percent usage most of the time, maybe 5% at peak times. Servers and IP Transit (if you have your own datacentre space) is cheap now days, so its better imo to have too much then too little.

Not when it's the tax payers money. If what you say were true there would be a thread about the government wasting money on computer hardware to merely satisfy the publics curiousity.
