Unfair Parking Ticket

So I managed to receive a parking ticket for parking in a restricted bay in Islington. I arrived late at night on a Fri, placed a visitors permit in the window for the following morning to cover the Sat morning restictions but didn't see the tiny yellow notice on the lamp post with a restriction notice. (Red circle in 2nd pic)









I've contested it already and they say they're happy (of course) that it was issued correctly.

There was no way I could see it as firstly it was dark at the time and secondly I got out of my car and headed into the flats in the left side of the 3rd picture. They say there were notices either side but can only see one quite a way in front.

Is there anyway to contest this further or am I just going to have to pay it? God I ****ing hate traffic wardens! /cry

If so, not much you can do, it was stated on the sign, admittedly it's pretty small but it wasn't that far away, nor is it covered up in anyway so I think you should just pay the £30.
 
Posting some pictures that don't require binoculars to view them might help.

Why aren't you allowed to park there?

Thats the original size that was Emailed to me as 'Evidence'.

I normally pay, and in fact did this time with a visitors permit as Sat AM is restricted. The yellow notice states it was 'Restricted' for some reason however. I'd guess this is usually due to road work etc but can't see any evidence of any.

Its actually £120 or £60 if I pay in the next 14 days. £30 I could handle but feel totally stitched up with this.
 
Not much you can do about it tbh .... The sign is posted even though its small and legally they're covered as the sign fits a minimum size I believe. Its also attached to the only post covering the bays there. Be glad that at least its yellow, Hackney put up a sign a few months ago that was black & white ... looked like a community announcement rather than a parking suspension.

Islington are right b**tards .... I lived on Highbury Corner for a number of years and got done for parking next to Highbury Field in a pay & display bay without a paid sticker. The sign was clearly residents permits but the bay markings on the road itself were pay & display. Took a lot of photos when it occurred, got my first appeal rejected (first appeal is a fill in form) and they said they had photos to show I was parking in a pay & display bay.

Went back found to the site 2 weeks later and found that the signs had all changed ... so I took more photos of those and made a huge letter outlining the differences with red circles clearly showing signs were different. To cap off my letter, I was lucky that I took a few photos at a distance where you could see the text and the house door & number before/after sign changes. Won the second appeal and didn't pay a thing .... turns out that the lazy road workers did a half-arsed job and came back a week or 2 later to finish it off.

Everytime you park in a restricted zone you must read the restriction sign. If the restriction sign is not next to your car, you need to physically get out and read the restriction sign. Failing that, drive up to the restriction sign and read it. But you must read the restriction sign.
 
This can easily be appealed and won as can about 80% of council issued PCNs. Councils are not very good at civil enforcement.

The first line of attack is the unlawful suspension sign. All traffic signs must either be prescribed by Traffic Signs Regulation and General Directions 2002 or have special approval by the Secretary of State for Transport. You will not find that suspension sign or any prescribed variation of it in TSRGD 2002 and the chances of it having special approval are as close to zero as you can get.

From memory Islington PCNs comply with the regulations but if you want to post it up (both sides) I can confirm. Blank out the PCN number and your VRN.

Do you have the NtO yet?

Also from the phots the suspension sign appears to be in a separate bay further up the road, was that the case?

Cool I'll scan it in an post it when I get a chance. I dont have a notice to owner yet no but am considering waiting for one and appealing it. Do I have to appear in person to do this? I'm guessing yes.

I'm thinking the fact that the notice is covered in a piece of printed paper makes it void somehow too, surely that must be grounds for appeal?

Oh and yes the notice was up the road, I'm guessing as there was no lamppost in the bay I parked in...
 
The initial appeal against the NTO will just be in writing to the council. Only if it is rejected and an appeal is made to the adjudicator, then it is best to have a personal hearing rather than a postal decision.

I can give you a very strong appeal for both.
