Vista Ult Retail Upgd from XP OEM questions that need confirming before purchase.

Ok I did post this in the other thread but I need it answering. I don't know much about the upgrade process for vista but I do understand I can not return any software after purchase so I want this confirming by gibbo if possible.


Ok I have OEM MCE running on my PC at the moment that has one activation left.
I also have XP Pro OEM that will not activate anymore due to hardware changes.

I was wondering with vista upgrade (retail upg packs);

Can I do a fresh install with the VISTA ULIMATE UPGRADE DVD inc formatting without having to install XP Pro/ XP MCE and for the VISTA INSTALLER to just ask for the disc?

As I have said the OEM XP Pro product key no longer works, however the MCE OEM does.

Now here is the thing, does the VISTA INSTALLER ask for the product code of the XP OS when checking the disc? Does it require XP to be varified (activated) for the rest of the installation or at any point require me to reactivate XP?

The bottom line of it is; Can I buy the upgrade version of vista and use it like the FULL RETAIL VISTA pack regardless of Hardware changes by using my XP PRO OEM/ MCE OEM disc?

You mean the licence wouldn't be valid or that it won't install or that it will only be valid with the remaining activation of my MCE OEM or what?
 
I mean it will work but it will be in violation of the Windows XP OEM agreement that you signed up to when you first installed it.

I've been through this. As long as you don't replace a motherboard you can activate as many times as you wish, just phone MS. If you have changed your motherboard more than twice, then your running illegal software and therefore an upgrade is useless to you.

No, because if you change the MB in the machine you revoke the OEM licence and therefore you don't have the right to use the upgrade without a qualifying product.

You can install Vista with an upgrade disc without needed a current install of XP, you will need an OEM or retail disc and possibly the product key.

Also not meaning to go illegal or anthing but I have £170 worth of OEM software in the XP Pro and XP MCE.

Is there anyway M$ can identify/stop form upgrading to vista this way?

By extension, yes. The upgrade is intended to be used to upgrade either a retail or an OEM version of a previous operating system. It doesn't turn an OEM license of an original operating system into a retail license.

But it will work abeit, illegally?
 
I dont think it will ask for a key, it will ask for the CD of the OS that you have which you put in the dvd drive and it will check then say insert Vista DVD.
 
Ok then. I'll wait untill the FAQ thread is finished. I means I will have to get vista HP Retail instead of vista Ultimate upgrade.

But the upgrade is £240 and non-returnable so I want to be B****y sure it works.

Yeah. I may be should wait. I'd rather do this legally. The only thing I want from ultimate is the name and the game performace tweaker.
