Want SE k810i but might have to get N95. Can I leagally sell the N95?

Hey all.

I want the o2 tariif online 35, that's £35/mo for 600 anytime mins and 1000txt plus 2000mins/mo of weekends to landline and uk mobiles.

Problem is those 2000 extra mins are with O2 long weekends which ends on thursday.

So if I want that tariff I need to sign a contract by this thursday. Now I want the SE k810i, basically for the camera, there is no other phone that I'm after atm, so I was thinking of getting the N95.

I don't want to keep it because of the poor battery life (don't complain to me about it had all these great features and so poor battery life, I understand that).

I'm just wondring if I got the N95 from O2, could I legally sell it on?

I just want to sell it for a price, just enough to cover the cost of a sim free SE k810i, the phone I want.

Could I do this legally or not?
 
Certainly you can sell it legally - the phone is your property and you can do whatever you like with it. Obviously your network will expect you to have the phone they've supplied you, and they won't necessarily offer any particular help or support getting a new SIM free phone working, but lots of people (legally) sell unwanted contract phones.

Bear in mind when working out what sort of price you'll get for it (particularly if you're thinking of selling it on Ebay) that the price will be dramatically reduced if you don't sell it new and sealed (ie. don't open it if you plan to sell it), and also that if the phone's locked to a particular network (and it most likely will be) it will also sell for significantly less.
 
Well, I don't know how much the K810i will be. I'm assumming my sim will be in the N95 box so I'll have to open it. If it's locked to O2, I'll have to pay for it to be unlocked. So yeah, I can see how the price would go down.
