Is it stupid to assume that if someone causes you whiplash in a crash that they take responsibilty for you can usually get some nice wonga out the courts...?

NB - this does not relate to me just curious more than anything :)
 
seems pretty much a given now, you get in accident, you claim for wiplash against other partys (if they are to blaim for the accident) pretty much a fact of life now (damn money grabbing so and sos - the only people that will make money out of it in the long run are the dishonest and the insurance companys)
 
Yeah but, I think you find you do need to have been to hospital to have it checked out and probably have some form of letter from a doctor to acknowledge that you are suffering from whiplash.

IIRC you can get quite a tidy little sum for it...up to £3000.
 
The only problem then is all the extra money you have to pay for insurance year after year due to thousands of people claiming for things like whiplash.
 
Some one manovering bumped my car when I was sat in stationary traffic the other day. He could only have been doing 2 miles an house, but he damaged the paint work across two panels so I claimed though insurance.

The next day I got a call from an associated company asking if I was ok or had suffered any injuries such as whiplash. They were very insistant that I should go to a doctor.

Yeah, I had a small bump last year when someone went into my backside and it turned out my towbar was stronger than her bumper :p

I had a call from her insurers, and they were very surprised when I said that I wasn't making any claims, damager or injury - and yet I had loads of people telling me I should sue for wiplash, inlcuding my then insurers :o

I think if I genuinly had some problems (someting a bit more than a stiff neck for a day or 2) then I'd probably claim something though, especially if I'd had to have time off work.

My parents claimed for whiplash some years ago after they were rammed by a police van. Whiplash is a nasty injury and causes a lot of pain, It can last a lifetime. My mum got more compensation than my dad because her injuries were worse.
The people that spoil the compensation system are the ones that claim just for the sake of it and not because the injuries affect their everyday lives.
 
I've had back pain for the past 2-3 years since somebody rammed into me while waiting to get onto a roundabout.
A massive £1200 out of that...
Doesn't look like it's going away any time soon.
I had 4 weeks off work 'n all.
Oh and to put it in perspective, a colleague of mine had £900 awarded because she suffered a day and a half of mild neck discomfort..

Mmmm, proportionate.
