lol guys, I never intended this to turn into such a heated debate, just wanted peoples opinions on it - as i said i've never been in this situation before.

I guess your right though, its not really the shops fault, they had a sign up albeit the wrong way around, so they are covered and accidents do and will happen.

I guess you just get a bit angry when things like this happen and want something done about it, but now we've all calmed down its time to just let it lie and forget about it.

I hate compensation culture but if she is genuinely unable to work (would depend on her job) then perhaps it is called for in this case.

Mopping a floor and then leaving a wet slippery surface un-attended is pretty sloppy these days - it is not an unavoidable accident. It would be normal in most larger stores to have a dry floor cleaner which leaves the surface totally dry after it has passed, or if there is a spillage a staff member would stand by the spillage until it could be cleaned totally.

If the shop is really small, too small to put up a barrier and too small to warrant expensive cleaning equipment, then it is also small enough to dry up the wet with a bit of kitchen towel.

If she can work though, and maybe her boss could put her on duties which do not require use of her arm, then I'd chalk it upto experience and get some ibuprofen.

You are out of order mate as are many others in this thread. This is a great community but is declining rapidly with insults to & from long term members. God knows where the mods are but you can be sure i have RTM'ed 3 posts in this thread.



As for the O.P. this is a personal matter, either you can go no win no fee or not, depending on how you feel. Personally from my own point of view it would depend on how the owners/managers were at the time of the incident and after. If cool and genuinely concerned i would leave it, if nonchalant and ignorant i would no win no fee them.

I wouldn't bet on it, the circumstances are important - a wet floor due to people traiping in water from outside is reasonably outside their control, in which case a warning sign is about as much as they can do.

They made it wet though, didn't attempt to dry it and didn't attempt to stop customers going over it (a barrier for example). If they could not use a barrier because customers had to walk over it (an entrance for example) then it is even worse.

Sounds like the shop was negligent is creating a potentially lethal hazard whilst not making their customers fully aware of it. As such, they owe a duty of care to your wife, which they breach. You will only be able to claim for what you have actually lost - the days of work are claimable.

Start off writing to the shop and see what they say first - might save you a bit of money.

You SERIOUSLY made a bad choice in asking this forum about this type of thing lol.

But yeah it's not really worth the time or the effort so get over it.

And who is Tru to defend the OP's wife? I'm quite sure that if the OP wanted to defend his missus, then he would have done so by now.

My comment was not meant to be offensive to the OP's wife - purely in jest.

Although you didn't direct your post at me, I'm sure you also RTM'd my post. I don't have a problem with you doing this - I even RTM'd a certain post, also. If anything malc30, you seem to be one the maturer users on OcUK.

However, I am not going to lay back while somebody directs offensive comments towards me. "Ignore them" I here you say - but what's worse, is the moderator's allowing the comments to stay.

Please dont claim....good grief.

My gran tripped over a raised edge in a local shopping centre. We didnt sue or anything but i think they put some black and yellow tape on the edge so people could see it.

I was told my foot wasnt broken,and two weeks later after much pain trying to walk i was told it was ******! Somebody made a mistake,it was late...after an old firm game..**** happens.
 
A few friends of mine were in a car which was shunted from behind. They all decided that it wasnt worth doing anything about it, but one of them thought 'what the hell, worth a go' and complained about neck pain.
This person has now got a new car, and a nice big deposit for a house and has certainly had a head start in life compared to the others who are left behind wondering what ifs .They are gutted.
