Work haven't paid me

Good morning all,

bit of a problem in that i work for a large company and it's now 2 weeks after full time earners get paid and I'm still waiting...

I've been paid absolutely fine in the past but very early last month i changed my bank details with them (you have to submit the request in writing and you get written confirmation back from them.) I got confirmation that these bank details had been changed. However when i checked my account on payday there was nothing in there. After liasing with my bank and payroll department it was confirmed that they'd sent it to the wrong account (not my old one just a completely made up account). They assured me I'd have the money on the friday of the following week. Fridays comes and goes and there's nothing, my rent is overdue, I have bills to pay etc etc. I call them up and they promise me they'll send a Telegraphic transfer of payment. It's now a week on and still nothing, they're now telling me it will be sorted by tuesday.

Only problem I've got is that I commute to work and I'm now running out of money to get to work, my credit card has had a temporary stop put on because I've missed a payment and I simply can't afford to make the journey. I've told them this and they haven't offered me any kind of sub just to make the journey and to be honest I'm loathe to ask to borrow money when it's not my mistake.

I'm owed a couple of lieu days and I'm just wondering where exactly would I stand in asking my manager if I could take my lieu days in the couple of days until this TT arrives?

He has a habit of being difficult and I just want to be sure of what my rights are before i say anything.

Personally I would go and see the manager, tell him that you will not be working until you are paid.

I'm sure your company is responsible for any bank charges because of their **** up. Go see CAB, sounds like solicitor time.
 
Simple. If you can't afford to get into work because work hasn't paid you, then you don't go in. Just tell your manager. There is nothing you can do about it. Its up to them.
 
You need to elevate this so that your senior line management (your's and the payroll's) is aware of the failings.

Be perfectly reasonable, polite and calm; explain that you're now incurring costs as a result of their mistake and you are not happy that their previous promises have not been met. Ask them to make an immediate same day transfer to your account (restate the details!).

As a side note, they have until about 4pm to get the transfer processed for today but give yourself a deadline of getting it sorted by 2pm. The transfer should cost them £15 or less, depending on who they bank with. Email and back it up with a phone call, emails can be easily ignored but a call gets you faster results. Do not take no for an answer, you are entited to the money and they are contractually obliged to pay it to you.

A CHAPS payment (which is what you're talking about) has an absolute cut-off time of 3.50pm. That is, if the instruction isn't with the bank by that time, it won't get paid. Even if it is one second after. The time is centrally controlled by the CHAPS system and Bank of England and the banks have no control over this.

Most company Treasury/Finance departments which control the funding of the business will impose an earlier internal cut-off to ensure they have a cap on funds going out. Normally this is between 2 and 3pm, so check if you want to go with this.

The cost to the company should be in the region of under £10-15 if they're a small irregular CHAPS user, or under £2 if they're a major user. (which is why getting your bank to make these types of payments is such a ripoff - they'll charge £25-30 for something that costs under £2!)

(Yes, I know this for a fact - CHAPS payments is part of what I do for a living :) )

DanH84, I believe the company is legally obliged to ensure you get paid on or before the due pay date. So if they are late, they should pay you as soon as they are aware and sort out the mess after, not the other way round.

Since they know they've messed up, they should have paid your correct account straight away and then reclaimed the funds from the wrong account after. You should not have had to wait.
 
Cheers for the help guys, they said they sent a chaps payment on thursday evening but as of 18:00 today it hadn't gone into my account. going to see if it's in tomorrow morning. I have escalated it all and we'll see what happens, they've rustled me up an extra day holiday for tomorrow so at least i'll be able to watch the match (of course if I'm not paid i'll be sipping on one lime cordial for 90 minutes).

Thanks for the advice all, it's clarified my position for me and given me a slighty stronger stance with regards to this.

Contacted the bank they haven't accepted or rejected any payments for the exact amount.

Contacted payroll they say they've sent it.

Contacted Manager, Area Manager they say there is nothing they can do.

Contacted HR and they said they will chase for me but can't give me a timescale.

Contacted CAB and they've told me it's an unlawful deduction and that i should write a letter of greivance and I could take it to tribunal but i just want my money, if it has to go to tribunal I'm in serious trouble anyway.

Shocking, gutted for you mate I can't believe the incompetance, care to name and shame your company?
 
Ok speak to the finance department and dont leave until its sorted.


Also check and see what their rules are regarding DD's. In my place of work, if the miss your pay by a day at all, they have to pay all your DD's etc and dont get this back.

There might be something in place like this.
 
Are you a member of any trade union at all?
If so ring them, you will have your money in no time at all mate. Worked on my old place when they kept putting off paying my overtime.

Depends which union tho, mine are an absolute shower.
