Xbox live account hacked or not ?

The DRM attached to DLC locks it to the serial number of the x-box that it was downloaded to, so that content can be re-downloaded for free should it get deleted for whatever reason. If the content can be re-downloaded, he's bang to rights. Punishment time for the constant lying.
Feel for you mate, but you know what you need to do.

My son has a similar situation, where he could purchase stuff without asking. I may remove the opportunity before tempation overtakes his current scruples.

Yes and No, the content is indeed locked with the DRM to the xbox to allow any other account on the xbox to use it BUT the account it was downloaded with can be used on any xbox out there and still be able to redownload the content but with that scenario the content may only be used with that account UNLESS the account is switched after the game has loaded.

Ive checked and i could only find security options for game content ie voilence etc but no security to stop anyone who access to xbox from buying anything.

^^ this is VERY annoying

my 5 yr old was playing a "trial" 360 game - one appropriate to his age ... anyway had forgotten it was logged onto XBOX Live and had no poits on it ... a screen must have popped up while he was playing on his own saying do you want to purchase - and obviously it takes you straight to the payment page ..

well if no points, it asks you if you want to top up your points - and if you have (had !!) a CC assigned to your account you can do it with no further passwords etc ...

unlucky for me he bought 45 quids worth of points !!

I'm not sure of many ways round it - you could say log out of your account but you try putting in your password every time on a 360 controller ...

I think it should allow you to put in a passcode - say a 4 digit one for any purchases

some market place games are so bad - even as an adult you can end up nearly buying as when quitting games, they seem to randomly assign X, B etc as "purchase this game"
