Ah fair enough, i'll have to check with the insurers what the deal is.

They say its a Cat C write off and that it will only need an MOT to get back on the road, unfortunately the third party STILL haven't taken responsibility for this so I'm gonna have to wait for them to accept liability or for the police to get further involved.

What a bloody palarva.

Is the car involved in the accident still in the owners possession??
If so, it rules out that it was stolen and that someone they knew must have been driving it. The recorded keeper will then be subject to the weight of the law.

Pretty crappy bud, someone did this to our old 306DT 5-6 years ago and we never caught them. Ended up having to claim on our insurance as the damage was estimated at £2,000 and the car was worth about £4K:mad:
 
Dont have time to read the whole thread so might have been said but if you are insured with direct Line I think they have a thing where they insure you for uninsured drivers hitting you ? ?
 
The police towed it from the middle of the road and as far as i am aware it's still in their possession, either that or its been crushed as it was a complete write off.
 
If it's so easy to use licence plate recognition software to fine people for speeding/not paying for petrol, why can't it be used to help crack down on uninsured vehicles? Sure it would require more legwork by the police but if it got these drivers off the road surely it would be beneficial.

i'm pretty sure they do.
i live in london, and last week the police set up an unmarked van with number-plate recognition cameras in the back under a bridge round the back of king's cross
further up the road there was bunch of officers and a transporter.
i went passed it about an hour later and there was a nissan x-trail on it already with a big sticker on the side saying UNINSURED VEHICLE
 
if they've written it off, and offered you £700.. then that is what you get, and the car is theirs, not yours.

It clearly states that it will remain my property.
 
I don't blame you, I have always been under the impression that in a situation like this you either take the money or the car, certainly not both!
 
Well i've been on the phone today to admiral/albanyassistance who have now let me know that i will not be getting a penny out of the 3rd party because the person who "stole" the car was never apprehended.

So now i have to go to the Motor Insurance Bureau and attempt to claim from them, trouble with that is i am only getting £700 and i have to pay £300 excess so if i do actually get any money at the end of this then i will only be getting £400 which is an absolute joke.

I can't believe its taken this long for them to just turn around and say no. I don't even reckon the car was stolen, the owner was blatently drunk, crashed in to me and did the bolts then reported the car as being stolen, which doesn't help me in the slightest as i have no proof of this so basically i am just stuck.

The way i understood insurance was that each car has a policy, if that car is at fault then the policy against that car would pay out regardless of the situation (stolen, owner at fault etc...) but the insurers justification for not paying out is because they don't have anyone to reclaim the cash from.

I know £400 is better than nothing but £400 isn't going to fix my car, how can they justify almost 50% excess on a claim?

including excesses from the motor insurance bureau which is a completely separate entity to admiral or any other insurance company for that matter.
 
Because that's the excess you applied for?

Anyway I'm sure you don't pay the excess on 3rd Party claims. Can't you claim it back too?

And each car does have a policy on it, but that only applies for the people named to drive it. If someone else drives the car then it's not covered on that policy.

I've been bustin out CSS a lot lately, it was only £9 so i thought why not!

I guess there is very little i can do other than dispute the excess based on the fact that its almost 50% of the entire claim, probably won't get anywhere though :(
