You can be charged for unreasonable wear & tear or damage but not wear & tear consistent with 'normal use'.


All that you need to know should be in your tennancy agreement.

Have a look here there's a load of posts about getting deposits back.

Was an inventory carried out (and signed by both parties) before you moved in?
If there wasn't, then the landlord can't prove what the state of the property was at the start of the tenancy.

indeed. i tried asking about inventory twice but didnt get a reply :(

however, even if there isnt an inventory your landlord is holding your deposit. so depending how arkward they are will depend how easy getting the deposit back is.

is there a letting / estate agent involoved?

Sorry - an Inventory wasn't taken.

We're renting privately, deposit is held by the landlords but an estate agent was involved in the original deal.

Looks like you stand a very good chance of getting all the deposit back, but as Stinky pointed out it'll depend on how awkward the landlord wants to be.
The Consumer Action Group site I linked to has template letters to use if you need to take him to court.

Sounds like the estate agents were only doing an "introductory only " service for the landlord (checking references etc), so the landlord is the one you must deal with.

post above is correct.

they agent was acting on a "Find a tennent" for x amount.

so all dealing with be landlord
 
In 4 years of renting I've yet to get a deposit back :( (over 3 properties). Even though, on every occasion the house has been left either as it was found, or in better condition (even gone to the trouble of hiring pro carpet cleaners etc). I really couldn't be arsed with it at the time, but good luck PenSkI.
 
When I moved out, the place was spotless and in perfect order. We got out deposit back a week later minus a cleaning bill. :(

Apparently they had to steam clean the carpets and clean up cobwebs.

I'd already hoovered, vax'd and steam cleaned the carpets. And there were no cobwebs when we left. :mad:

Only joking fella, good to know.

You'd hate me though - we viewed the new place with the landlady then ditched the agent and dealt with her directly. Saved well over a grand between both parties.

that aint legal. lol you better hope the agent doesnt find out haha. but fair play. someone had a brain ;)
