Darren Nixon, a 28-year-old mechanic, was quickly surrounded by armed police after departing a bus and thrown into a police van after a panicky passerby phoned police, reporting a man pulled a gun from his pocket, gripped it with both hands and aimed.

In reality, Darren was changing tracks on his black Philips MP3 player. To keep the public safe, the police now hold on file Mr Nixon's fingerprints, DNA and mugshot, despite his obvious innocence. It will also be kept on file that he was arrested.

saw this in the paper last night. wouldnt be happy with having my details on record.

does that mean he has a criminal record now?
 
Thats pathetic, if it is on his record then although innocent, it will be bought up in the future.

I got a story similar to this...Ages ago my mobile phone got stolen in a pub, in order to file a claim through the insurance company I had to get a crime ID from the police, which I did, the claim then went through. A couple of years later I had applied for a shotgun and firearms certificate, when the police came round to do the usual person and security check, this was bought up, but on paper it had said that I had stolen a mobile phone from a local pub and thats how it came across on my record.

Stupid really, you really have to be careful because the police can screw it up.

No because you don't get a criminal record for being arrested, you only get one for being found guilty of a crime. Clearly in this case it was obvious he didn't do anything wrong.

I think the obvious solution to this problem is make a law that says all MP3 players, PDAs and mobile phones have to be offensive bright colours so they don't get confused with guns:p Which will work great until they start making guns in shocking pink.
 
DNA evidence is kept on anybody that is arrested, it should be removed if you aren't convicted of anything IMHO, obviously "innocent until provded guilty" means nothing and the Government now has your DNA!
 
That's crazy! I wouldn't be fussed about my details being stored but I would be very annoyed that they kept in on file that I was arrested for suspected firearm offense. Although I bet that's a complete exaggeration, the full story was that the police kept a file stating that he was arrested on suspicion of carrying a firearm but turned out to be unwarranted, and was just a case of faulty info. With the tonnes of paperwork the police are made to complete these days it's hardly a surprise that someone records why armed officers were dispatched, I suppose that doesn't make as good a story though...
 
He's lucky he wasn't shot. I find it incredible that instead of profound apologies they decided to keep his DNA and fingerprints as if he was some sort of criminal, that is very worrying.

Well it may be because he did in fact have a gun ditched it before the police arrived/found him then if they do find a gun they can quickly rule him in/out.
 
Well even if you get a caution chances are you've been arrested so your DNA etc. is then on the Police computer.
