Sold Motorbike Dilemma

Well here's the dilemma.

In Oct/Nov 06 I sold my motorbike to my cousins bf while I was moving over to Edinburgh. Now I waited patiently for payment and gave me extra time as his dad died in Dec 06.

So come around March 07 I was laying the pressure on for him to pay up and he finally did, so he goes round to a friends house back home and gives her the money. He gives her £100 instead of £300.

So I phone him up and i'm like WTF? He said we'd agreed on £100 and to not scam him out of more money just because I need it. :confused:

Anyway my cousin starts yapping to me as well now saying i'm acting like a **** and saying that I was originally just going to give him the back.

Any arguement she put forward was just countered by me and she wasn't explaining any of her reasoning behind her arguements. As like why would I sell a perfectly good bike, helmet and jacket for £100 when the helmet alone cost me near that. Then she moaned that the wing mirror was cracked and I told her i'd given him my replacement wing mirror I had for it.

Anyway the dilemma isn't about the money as there is no way to prove whats what. And I couldn't be arsed as it'll just be an arguing match back and forth.

My dilemma is that the bike is still in my name so i'm still responsible for it and he is refusing to reply to me or answer my phone calls so I can get his address and DOB so I pass the bike on.

So what do I do?

One possibility is that I could report the bike stolen then the PSNI would inform the DVLNI that i'm not in ownership of the bike. The bike isn't insuranced anymore and I still have the paperwork for it being declared not in use anymore. So i'm not exactly commiting insurance fraud.

So wise OcUK what to do what to do?

While you moved to Edinburgh? That reads like you've moved back. Can't you go get the bike or the £200?
 
Just inform DVLA that you are Not the owner of said Motorbike & ignore the other two people, Lesson learned an all that.

£200 is a lot to write off like that, it sounds to me like the guy has scammed him, cos he knows he won't do anything being so far away.

He did ask What to Do though Not What Would You as in Me would do. Personally I'd take it out of his face but then that's me & not the kind of advice i give out to strangers :p

I've already accepted that I'm out £200 my own fault. It was a private sale so I can't do anything about it. And i'm just looking now to get my name of this motorbike as i'm still responsible for it. So to me reporting it stolen from the registered address (my mums) seems like an idea as he has stolen it from me by not paying the full amount.

I think you'll find that Legally he hasn't stolen the bike just failed to pay for it. Legally i bet your only option is small claims court.
Like i said just Notify DVLA that you are not the current owner & give them any details of new owner you can even if it's only I know the bloke through this (Insert cousins name addy). You'll get a letter back off them when your name is removed from the log book.

Give your local PSNI station a call and explain the situation. Tell them that you agreed a price of £300 but so far have only received the "deposit" of £100. Tell them that you did not intend to transfer ownership to him until all monies were paid and as such, you now consider the bike to be stolen as the other guy is refusing to pay for it.

They will be able to tell you whether or not this is the correct course of action and if it is, they will be able to sort it all out for you. If not, they will be able to offer you advice on how to resolve it.

Really its your cousins bf, get her to give you his details, get the rest of the family involved if you want some revenge so they all know that they stole from you...I'm sure they will soon see there mistake and pay up the £200 or give the bike back and take the loss of there deposit.

Our family aren't close at all, my aunts don't talk at all. I knew my cousin after randomly meeting her when she worked round the corner from me and before that we hadn't seen each other in years. But she isn't contacting me either so I don't have that option.
