Ok then. You have a DVD in your DVD drive on your PC, set as a network share.

Is it illegal for your mate to watch the DVD in your drive on his PC?
Yes. One way or another, material that was never paid for is being watched. Whether you upload it over a network or use a networked drive, the end result is the same: Your mate is watching a DVD that he never paid for :)

Download != illegal
Uploading = illegal.

So #2 is legal, technically! ;)
It isn't, it certainly isn't legal to be uploading such material, and I'd argue that it is a civil offense to download it over that network, too.

Note that when I say these things are illegal technically, of course you're unlikely to be in trouble because whilst they are illegal, they aren't crimes (although I think uploading the material over your network share is a crime, much like uploading over bittorrent). You would only be in legal trouble if someone pressed charges against you, as it is a civil offense.

That said I would love it if someone who knows a bit more about this came in and confirmed this because there's a high chance I'm talking rubbish :p

Ignorance is, indeed, no excuse in the eyes of the law. The moral of this is always have a damn good excuse. One you believe so much you can either convience the jury or pass a Polygraph on!

Most cases to date have been successful because of the uploads (thus distributing copyright material) and not downloads. If I am downloading copy of x what is to say that I don't already own x?

I may be wrong and a lot of my knowledge is based on what happens in America (RIAA vs The People!) so I also could be talking crap! ;) :p

I think you are wrong. By transmitting/broadcasting etc an illegally acquired copyrighted file he's still breaking the law as is his fwend. :p

What do you think he's doing? uploading to a network is no different to uploading to the internet.

Another hypothecial situation, say someone downloaded a tv show by torrent, that was then broadcast for free on tv couple of weeks later. Would that be considered illegal?

Yes that would be illegal.

Very simple test of whether it's legal.
1) are you making a copy (however temporary)
2)do you have authorisation to make that copy?

If you don't then it's illegal.
