Been ripped off by a shop - need advise please

would you try a pair of shoes on, if they were the same as the ones you were standing in? seems crazy to me.
i would have checked

are you sure that some of the stitching has not come undone **cough cough**


if thats the case you are entitled to a refund as they are not fit for purpose and if you return them in under 28 days legally you are entitled to it

That's all irrelevant, you asked for 12s and they gave you 11's, it was their mistake and as such you're entitled to a complete refund as far as I'm aware:)

great advice, fraud. especially after he's already been and hasn't mentioned it.
there's nothing he can do. it's his own fault for not checking the product before handing over the money
either accept the credit or sell them

and you feel "violated"? please..

they gave you the wrong shoes, but its your responsibility to check items before purchasing them. it's your money

anyway don't take our advice get on the phone tommorow to your local trading standards, they will tell you exactly where you stand... in your size 11s or 12s:p

On a side note even IF the stitching was faulty they would still give him a credit note surely?! :confused:

Firstly, you are entitled to a refund. Get trading standards involved if you have to. Just keep going until they back down.

BUT you should always try shoes on. Even if I know a pair will fit I still try them - different manufacturers have different interpretations of a size, e.g i'm a 36" waist but my work trousers have to be 40" to fit! :/
 
Hilarious that some people think you're not entitled to a refund! Fact of the matter is, you asked for one thing, were given something different and therefore under the SOGA you are entitled to a full refund or replacement, as they cannot offer a replacement then a refund it is, NOT a credit note.

Surely if this store has been doing this for a long time it would have been reported by now?? Unless of course it is not illegal.
 
I'd be writing a letter right about now.

Yup, get details of HQ off their website and CC it to the head of the store you had the experience at.

Just stick to the facts, tell them your legal rights, tell them how you feel and what you want.

Also, don't forget to send it recorded delivery.
 
my work mate had the same problem here mate with the same shop, he goes that it u get the number of head office and make a huge complaint they have no choice but to give u a refund.

Aye, but they were described as a size 12. Therefore they didn't match their description.

You ARE entitled to a full refund, not a credit note.
 
i had 4 of them there and gave it some welly! they just kept saying they could not do it, and were not allowed too.



no cos i asked for a 12, she then took the box around to the til. You have to have a little trust and faith



they have nothing else i would want or need plus, i don't want to spend in that shop. With there 'credit note system' they must make soooooo much money as no one ever gets there money back from the store once they buy something.


How did you pay? credit/debit card? get onto bank etc and initiate a chargeback due to fraudulent behaviour.

My bank does this for me no problem. Get the money back same day as well. I'm done taking any **** from fly by night companies.
 
Does the box say size 12? Or are they 11s in a 12 box? If they in a 12 box they are not sold to you as ‘didn’t match their description’


At the end of the day it’s down to you to check what you are purchasing.
