Me and some friends are going to Spain in August, and we are 17. One of our parents has asked if we could get her cigarettes from Spain cause they are a lot cheaper. None of us will be 18. Will customs take them away from us when we come back to England?

If they are under your allowed limit without declaration, why would customs have any suspicion to search you? They rarely search people coming back in so I'd say you'd get through fairly easily.

Is possession/smoking under 18 actually illegal? I know the buying age is 18 now...

It'll only be about 30 packets we bring back, way under the allowed limit of 3200 cigarettes/160 packets.

I think it'll be fine personally, but just want to be sure really. :)

within the EU there is no limit as the duty has already been payed - as long as they are for your personal use you can bring over as many as you like.

The legal age for purchasing alcohol in both Spain and the UK is 18.
It really doesn't matter if they check your age before purchase or not.
Until you are actually 18 you don't have a "customs limit" for alcohol.

So if four of you are going and only one of you is actually 18 then a car full of alcohol is going to be difficult to explain as legally all of that alcohol is for the one 18 year old who isn't going to be passing it on to anyone else.

To both purchase and smoke tabacco in Spain you have to be 18 (Royal decree in 1988).
So ocne again, with the age restriction being 18 in the UK and same being in Spain any cigarettes you bring back will have to belong to the one 18 year old in your party and not to be passed on to anyone else.

As customs can and will take cars if they suspect not everything is above board all I'd recommend is you proceed with caution.

My mum baught back about 3000 cigs from Dubai duty free for my brother in law, got to heathrow airport and they were all siezed :(. They were asking for £70 duty for every 200 cigarettes, which my mum coudn't pay!

They were saying you're only allowed 200 per person over 17 years old. This was after the law change from 16 to 18.

Meh 18? Why do all countries have 18 can't they be like Holland and allow alcohol and tobacco from 16 .

Always annoys me that when I'm on holls I can't buy any alcohol while I've been happily doing it for 14 months now here.

I would think any 16/17 yr old smokers are annoyed too by those rubbish foreign laws.
