6 month ban and £275 fine for woman who killed a motorcyclist

According to reports in today's Telegraph newspaper, Lisa Badham-Moore, 35, veered into oncoming traffic when she took her eye off the road to reach for the tissue.

She ploughed her Vauxhall Astra into Laurence Higgins, 54, who was riding his motorbike, killing him.

Badham-Moore admitted driving without due care and attention at Spalding Magistrates' Court.

After the case Mr Higgins' widow, Kay, 47, who had tried unsuccessfully to have the case taken to the High Court, said she was outraged by the sentence.

She said: "I'm disgusted with both the charge and the sentence because justice hasn't been done.

"Her barrister said she has got to live with this for the rest of her life, but she's not the one living in a house without her husband.

"A lot of people try to portray motorcyclists as being speed freaks, but Laurence had been a motorcyclist for 30 years on and off and had never had an accident.

"He was driving very carefully, and that was confirmed by someone he had overtaken just before."

Badham-Moore, of Gedney in Lincolnshire, was also fined £200 and ordered to pay £60 costs and a £15 victim surcharge.

If I drive on the road with no insurance I would get a more harsh punishment than that.

Disgusting.
 
Shocking!
She's killed someone through driving dangerously. You'd get more than that for doing over 100 on a deserted motorway with no one else about
 
If i get 1 more speeding fine i lose my licence for 6 months and would probably get raped with a huge fine for getting a second one and running out of points.

That bs:(
 
And then a lorry driver gets 4 years for killing someone in an accident - dangerous driving... for using hands free kit.

What a joke. If I was related to that man in anyway I would serve some justice up to said women my self. She should have her eyes ripped out.
 
Dont flame me for defending the decision, but she wasnt driving dangerously. She was driving without due care, and therfore the sentance fits accordingly. A lad I went to school with got exectlythe same, and that was for killing a schoolkid on his pushbike.
 
Looking at the various other sources on-line (google her name, and you'll get a pile of them) it looks like she got such a light sentence because there were no witnesses to the crash and they didn't think they could get the higher charge to stick without them. :(

The markings on the road would have indicated she was on the wrong side.

I assume she admitted what happened.

She was driving without due care and attention and killed someone. As such she killed someone accidently. Thats manslaughter isn't it?

that doesn't dismiss the fact she was on the wrong side of the road (for no reason) and killed a man. that's enough evidence right there surely??

but still causing death by driving without due care etc should not be a slap on the wrist and a "Now now, be more careful!"

Friend of mine is in court today for drink driving (she drove from one side of a car park that gets locked at midnight, to the other side so she wouldn't get clamped - copper caught her driving those 10metres) i bet she gets worse than that.

yes she should have driven across the car park, but makes me sick that shes going to get more than someone who has killed a man.

for the recorded she was over the limit by 4 mg of alcohol in her breath test.
 
This does appear to be an extremely light sentence considering she has actually killed someone through her own negligence.

Is the "Causing death by careless driving" offence which was introduced in 2006 actually in force yet? It was made for exactly this kind of scenario where proving dangerous driving was impossible.
 
You can't get much more dangerous than driving on the wrong side of the road.
