Been summoned to court

To be honest despite every ones good intentions this isnt the best place to ask where you stand legally, get your self booked into a solicitor and find out really where you stand legally as by the sounds of it thew advice you've received so far from the court hasn't really worked.
 
Dont think I can afford a solictor at the moment.. how much would one cost? :\

I know the only punishment they can give for not producing is a fine and they cannot actually ban me for that. And I did have both license and insurance at the said time so they can't charge me with either of them. All I can think is that they've ****ed up their end somehow! Even the woman on the phone was confused when she looked at my case and said she can't see why this has happened as she confirmed they had recieved my documents well within time and also that I do defently have a valid license and insurance.
 
You have been charged with either not having insurance or not having a license, or both, if they have decided to ban you.

Obviously you are not guilty. Get a solicitor because nobody here is qualified to offer you professional advice, we can only offer you our opinions.

My opinion is that you should attend court with indisputable proof you were both insured and licensed to drive on the date of the offence.
 
Why you're still asking for advice on OcUK I have no idea.

Enough people have said speak to a solicitor.

Surely the cost of a solicitor is better than having a ban?

The court has both these there at the moment, they still have both parts of my driving license and my insurance certificate. (they've had these for 2 weeks+ PRIOR to the first court hearing)

I can see them being in the post on the way back to me now on the day of court!:rolleyes:

To all those saying get a solicitor, is it really worth it. The only explanation is they have charged me with either not having insurance or not having a license, both of which I've got indisputable proof of.
 
And they can **** right off if they think they are banning me! I will just carry on driving if that's the case and not bother with insurance like many others seem to do anyway.
You would be totally crazy or stupid to drive while banned and no insurance...

Try asking someone that has hit and injured a person badly while driving with no insurance what there life is like with be sued for god knows how much money....

Driving without insurance is stupid, the police like directly to the Motor Insurers Database whoch can tell them of any reg is insured on that day. To sum up you'd be ****** if you were caught.

Hence the suggestion to use foreign number plates ..
 
A lot of solicitors provide the first consultation free, at least they will be able to tell you where you stand and what the out come is likely to be.
If you cant afford to carry on using a solicitor ask to see the duty solicitor when you attend court and as others have said make sure you have all your paper work in order when you go.
Phone the court up and ask them if the paper work you sent was even looked at regards the first court date, also go and pick them up, don't let them post them back to you otherwise you take the chance of not having them for your second court date ...imagine having to explain to the judge why you cant show your documents for a second time tot he judge :)
You really do need to speak to some one though as youve done nothing wrong but could get screwed for it :(
 
Get a solicitor mate. You are mad if you don't. Do you know your way around a court room? Who does what etc? What is admissible? etc?

That is their job.

It shows the court you are taking things seriously as well. No solicitor can look like you dont care what happens and things can be worse. A solicitor will also know if the sitting magistrate is harsh or lenient and advise you accordingly. There are so many reasons to get a solicitor. If you dont I wouldnt expect much sympathy on here if you get screwed.
 
i did this once, took the valid documents in got a 50 quid fine and that was that.

as long as you have valid insurance etc i cant imagine it being too harsh. I certainly wouldnt be getting a solicitor lol
 
A friend of mine got stopped for speeding last year and had to attend court for not producing documents. In the end he got a one your ban, I have no idea how or why when he had both insurance and a license, but that's what happened.

Hmmmm this doesn't sound too promising! I thought for not producing all they can do is issue a fine. Obviously for not having a license and insurance I could get disqualified but surely not just not producing!

Are you sure your mate wasn't done for speeding also and that he defenty had valid insurance and license?

He got his 3 points for speeding, and yes he did have valid insurance and license. I don't know all the details of what happened in court but he showed me everything he took to court and it clearly proved he had a valid license and insurance.
