Ebay, paypal dispute (Item Not As Described) "Apparently"

Was the item flag on the listing 'New' or 'Used' - regardless of what the text said in the description?
 
Then as far as I can see, you missold it to him and he's in the right. I agree that he should have read the description, but you stated in the options it was new and it clearly wasn't.

I have no idea how Paypal would view this, they aren't known for taking the logical approach.

lol not at way he claims it. Ie no box etc i provided detailed pics and i didnt say i had a box + everything is unused and wrapped...

The thing is, it is new, pictures i provided do indicate this and i basically said i tested it and it worked all i really did before i sold it off. Card clean as a whistle. Everything else still wrapped up. All cables etc. The driver disk. Also so called scratchers, there were none. Not to justify the amount he wants refunded back... ill take my card thankyou and reauction it.

My friend sold his card the same as new not long ago he didnt have ANY accessories or anything and listed it under new which it was similar story to mine also went for more than mine too which is nice!

Nah i didnt actually really check, i put all details into description that it is new etc

I dont see how he still even has a point vs this, it is so obvious way he replied he is trying to get a VERY cheap deal....

My item far as im concerned was described accurately as possible and i provided many detailed pics.

He reports you to ebay/paypal. They investigate by reading the listing, and checking it against the evidence.
Correct item? - check
New? - er... no, it's used.

Instant grounds for them agreeing that the item description was wrong.

It's a technicality, but I think it's one that might lose you some money.
 
Well if you said new, he has a point. Prices on ebay reflect whether it is new or not.

If it was new and is from a board partner it should have a box and of course not used. if I had bought it thinking it was new, I'd be annoyed as well.

Give him a partial refund or you will lose everything via paypal when they ask him to send the item back to you. Save both of yourselves some money. You won't get £126 for an unboxed used 8800gtx on ebay anymore.

Hmm i don't know honestly, pictures were accurate, description accurate. If they rule against that im never using paypal again. Only bank transfer and ill be taking my card back and may pay mr dispute a visit face to face.
 
Sounds like the guy has a case I'm sorry to say. If you advertised it as new, it would have to be unused, which it wasn’t, so it’s a mistake on your part really.

Not sure how it will pan out, but unless he withdraws the dispute, be prepared to cough up a refund of sorts.

I would tell him to beat it, maybe even beeeeat it just beat it like that.

Yeh i dont mind and ill claim fees back... ill just resell my card imo.

Yeh i would but paypal reversed transfer to bank and are holding funds.

Sounding silly cause i want to collect my card and not pay 10 quid? i probably made a slight mistake but still doesnt change fact it is still basically a new card. and i would appreciate not being branded a liar on an internet forum after providing paste of messages, thats just as silly so please dont be a hypocrite.

Nice lie. No unboxed 8800gtx was sold on ebay for £135 inc or exc delivery in the past 2 weeks.

The closest item was one at £136 with a zalman waterblock. Which is yours I'm guessing.

Only 22 8800gtx cards have sold since 25th september.
