Parking - is this allowed?

Bit OT, but apparently it's entirely legal to park across someone's drive if there isn't a car on it (but only outside of London)
 
I've got exactly the same problem, my neighbours always park opposite my drive making it a pita to get in :(

I'm not sure there is anything you can do, although if you are on good terms with them I suppose you could have a word.
 
Watched a program on this very situation last night..

Basically it said that anyone can park their car infront of your drive (regardless of dropped kerb or whatever) as long as there IS NOT a car in the drive...

If your car IS on the drive and he is blocking you in, then it IS illegal...

Not sure on the law in England etc, but here (Scotland) parking across a drive way depends on several factors.

Does the vehicle cross a public path to reach the driveway and if so has the kerb been dropped to meet the road?

If so and planning permission has been sought and granted AND the kerb dropped then it is illegal to park across the driveway.

If the kerb has been dropped without permission then you can park across the driveway if you wish without fear of prosecution.

If the kerb has not been dropped and, for example, wood ramps have been placed at the kerb to ensure ease of access, then the chances of planning permission being sought and granted is very low. After all who is going to go to the bother of seeking and getting permission and then do nothing? If this is the case then it is perfectly legal under the Road Traffic Act (Scotland) to park across the driveway.

Planning permission is not required to create a drive-way in a semi or detached building (unless it invloves raise sections or other building work), only permission to drop the kerb outsite.
 
Looks like there is plenty of room to reverse out there in one swift move. Fair enough you may have a bit of a fiddle and have to mount the pavement round but I have a similar situation outside my house but my road is far smaller than yours. I just reverse into my drive now as reversing out in the 3 series WAS a nightmare.

Saw it on a TV show yesterday and apparently, you only have a legal right to access the highway, hence, you can't block someone in their drive. It doesn't matter if it's across a dropped curb either (except in London). However, the police can remove the vehicle if the car is on the pavement, in a dangerous position or obstructing the highway.

To reinforce what others have said, it is only illegal to cause an obstruction, as opposed to an inconvenience
 
Really can't see a problem. I have cars ocassionally park opposite my drive. The road is 2/3 of the width of that one, their is no curb on my side and the entrance to the drive way is narrower. Worst case scenario is I have to do a couple of shuffles to get out but I've never been stuck.

I don't think you have anything to complain about really unless its physically impossible to get your car out.

where ? cant see any other place he could park whithout doing the same to somone else in those pics :confused:

looks like he would have to walk some distance to park elseware
is this what you want him to do ?
 
Hmm ye I agree, dont see too much of a problem...

Getting the 5 series in/out is most probably a PITA looking at those photos. Focus, fine, but that isn't his car. It also means the Focus has to be moved before the 5 can be (which is irrelevant, that's driveway size for you :p).
 
No it doesn't - the drive is much longer down the side, but there were 3 cars down there when I took the photo (not usual - we're considerate when we have visitors ;)).

My car usually parks in the other bit too.
 
That is fairly inconsiderate parking. If I was parking somewhere like that, I would look out for blocking peoples driveways. They probably just haven't thought about the effect on other people.

I'd have a quick word & see what they say.

But they're not blocking anyones driveway except their own. The problem is that when they block their own drive the OP finds is difficult to get in and out of his drive which is opposite to where the red car and the 4x4 are parked.

I personally can't see anything wrong with where they've parked, they've parked their cars(s) where they can see them I suppose, no idea if that matters to them. Personally I wouldn't have a word as it would be a bit of a strange request to ask them not to park in front of their drive.
