Yeah, they offered me 600 mins instead of 200 so go for it.

I spoke to another person who was having none of it so I'll have to try again!
 
Hmm I'm already on 600 mins with unlimited texts, and of those 600 mins I barely use any because my Mrs is one of my magic numbers...

Will have to see if I can get anything. I'd probably still cancel anyway just to get a new phone so I can make a bit of dollar that way if I can't get any discount.
 
just cancelled it:).............try this gave ofcom a call and get a ref number call orange ,and then they will call you back and with in 5 minutes all done.i dont plan on getting a new deal anyway as i can use my work phone for free.they did offer me 400 minutes unlimted txt for £10 per month.good luck chapps:)

I would have bitten their hands off for that deal!! Do you have a reference number or anything so I could prove that that has been offered to someone else?
 
just tried and been fed the same 'can't cancle till you recieve the text message' line. apperently everyone will be recieving that text message over the next 30days.
 
My brother just cancelled his Orange contract with 12 months left on it. On the second call to customer services once we talked about the T&C's change to the nice guy on the phone, he cancelled it no problem. Got the PAC too! :)
 
Just tell them that's BS! You are affected whether you receive a text or not.

I tried that but apperently everything you read on the internet is bs and hearsay and is irrelavent according to the guy I spoke to.

going to give it like half hour and try again, hope the guy hasn't put a note on my account saying I've already tried once. when I called he asked where I'd heard about it, said I wasn't 100% if I'd recieved the txt as I'd had to hard reset my touch hd(loosing everything) to which he put me on hold and came back said I hadn't been sent it(apperently they can check if you've recieved it but not when you'll recieve it as I asked when I'll be getting it).

Just tried again, this time pointing out that I'm a contracts/IP lawyer and the guy took a slightly different tact with me this time. Clause 4.3 gives a right to terminate, however the notification provisions say that notification must be in writing. Their agreeing to let people cancel over the phone is thus going further than they're contractually obliged to. He thus said I either:
a) wait for the text and they'll let me cancel over the phone or
b) send them a letter exercising my rights under 4.3 whenever I want.

They're playing this based on the absolute minimum they have to do. Hmm...

By the way, the guy said to me that I can't rely on hearsay to and I asked him whether it is correct that it applies to all contracts prior to June this year. Once he agreed that it did I thus said I'm not relying on hearsay, I'm relying on his statement on behalf of Orange.

Orange have issued the PAC code as per this thread.

DEFAULT UNDER AND TERMINATION OF YOUR AIRTIME CONTRACT

8.1. If (i) within 7 working days of receipt of your Equipment, you have failed to arrange connection of the Equipment to the
Network, if not already connected, (ii) you move onto a tariff which offers a lower rate monthly subscription during the
Minimum Period, (iii) your Network Operator ends the Airtime Contract in accordance with its terms (including not limited to
where you have failed to fulfill your payment obligations during the Minimum Period) or (iv) you end the Airtime Contract for
any reason within 9 months (if your Minimum Period is 12 months or more) or within your Minimum Period (if your Minimum
Period is less than 12 months), and the relevant tariff includes a discounted Mobile Phone/Smart Phone, you must in addition to
paying any other charges under the Airtime Contract either:

8.1.1. return the Mobile Phone/Smart Phone to us by sending it special delivery to Online Returns, CPW Logistics Centre,
Bilston Road, Wednesbury, W Midlands, WS10 7JN: or
Mobiles.co.uk Terms and Conditions of Business - Updated 10th October 2007 by MM

8.1.2. keep the Mobile Phone/Smart Phone, in which case you agree to pay us the amount of the discount being the handset
only purchase price of the Mobile Phone/Smart Phone less the amount paid by you at the time of purchase for the Mobile
Phone/Smart Phone (the "Discount").

I fanyone speaks to orange can you ask them if it also covers business tariff's thanks
I;m struggling to get out of a Mis-sold contract and this would help save me £5k

I tried that as well but the guy just wouldn't have it, said till I get some direct from orange(email/text/letter) it doesn't apply under their t&c. I did say that over the phone also counts but he kept saying I have to wait till I get the text.

as I said I hope he hasn't put anything on my account as I've read at least one person say they had a note put on their account saying that they're not elligable so doesn't matter who they speak to they get the same reply(this is on the moneysupermarket forum).

NOt an expert but I think your ok there is another clause that states that handset DONT form part of the contract.
Its there so you cant cancel your contract due to a faulty handset
But it comes in handy when cancelling your contract for other reasons
