Cars clamped... WTF?

you keep saying about your neighbours not minding about x and y.

but if the cars where SORN, and are not visible from the main road - then do you really think the DVLA would drive up there and clamp them? Sounds like one of your neighbours has rung them, and reported the cars for being on the 'road' with no tax.

If the clamp is hooked round the steering, then unbolt the track rod and remove it. Remove them, without damaging them and then padlock them to the gate as trophies.

I mean it could be but I doubt it. There are a handful of neighbours with cars, even less that use the carpark. The guy at DVLA said their system didn't show SORN, but I have print out of webpage, ref number etc. I speak to folk regularly no one has seemed bothered to my face.

Yeah I think they have actually, just come round. There was an untaxed vehicle clamped last week on the main road and the owner had been clearly using it - he just set the thing on fire. Big style.

Council phoned back, guy from road maintenence got passed the question. Was quite high up interesting to speak to told me exacly who I should contact on monday - local area surveyor.

The van or transport they turn up in will be looked at, but not by me. More details by me here would be silly. :p I will be as awkward as possible to them up to Secion 5, and if I don't like what I hear the GF will be filming my insanely sexy grinding motions...
 
The only question of a puplic/private road is WHO pays to have it maintained.

If you get a massive pothole in that car park, who comes to fix it? is it the council or do you pay a maintenance fee?

Never had to be any repairs in my 7-8 years here. Never had this happen either. The council refused to lower the speed hump saying it was our responsibility about a year and a half ago when they resurfaced the street. They never resufaced the road into the carkpark between the blocks or the carpark itself. Not that it needed it..

If it is public, its never been cleaned by street cleaners I clear the autumn leaves and mud etc. People have fenced off their rear gardens etc within the communal area.

If it was owned by the council I would have thought it similar to a public park, owned by the city and available to use for everyone? Would we not have to make keys for everyone who wants one then? Kind of circumnavigates the security aspect.

Are you sure - we have to pay for our road but I'm pretty sure I cant park cars without insurance on it etc?
 
I really ain't sure. I'm going to knock next door see if my neighbour will get her deeds out her shoe box!

If it is council I'm shocked and if thats the case there is no off road parking for miles in radias, but will have to wait until monday to speak to them. In fact that wouldn't suprise me with ECC and NPC. Its like an inbred relationship.

Took two more shots for reference, the annoying hump looking in towards the back garden. In the 19 its bloody nighmare due to low ride, I can get it over with fine pedal control but a lot of friends scrape and bash sumps. Council wouldn't fix nor remove. Don't have a pick or cement mixer and cba doing it manually. Not even sure if its council or comm. now.

I'm sure that your land is classed as private land. Even if the council owns it, there is no public access. As you are in Scotland, Black v Carmichael 1992 SCCR 709 comes into effect. As you probably know this renders clamping on private ground in Scotland illegal as it is said to be Theft and Extortion. Both of which are criminal offences. You could see if the Police would be interested in helping.

Personally, I would not even entertain the idea of negotiating with them, they are blatantly breaking the law. Also complain to the SIA about their actions.
