Cars clamped... WTF?

I would get sick of seeing 2 un taxed cars on the car park I am paying for, its just a mess and brings down the look of the area.

You can download a copy of the deeds from the internet for a few £ if you need to check who owns the road. I own part of a private road and it is clearly marked as my property in the deeds.
 
If it's private property in England and Wales, the owner can authorise clamping on their land with the relevant signage etc in Scotland you can't.

If the land is community owned then the owner is the community, so DVLA cannot clamp a SORN car owned by a community member there.

In this case private property is any property which is not a public highway. e.g. a private car park. It would be owned by someone.

Further to our telephone conversation today I agree that to the lay person it would appear as if the ex City of Edinburgh Council (housing department) car park at the rear of your property was private property and did not form part of the public highway.

thats as far as I have. NPC still wanted to pick it up tomorrow last I spoke to them the manager said I had good grounds for appeal but the cars had to be impounded in the mean time. Appeal would take 10 days, if I got it cars would be returned if not I would have to pay £860 in total for release and impound fees. I think not...

npc manager said at first if it isn't public highway then its public groud, and I can still get clamped on it as per legislation change last year. still thinking this is a bit crap, got back onto the council who were quite simpathetic then went on to say that it was private as per the above email. forwarded this on to DVLA/NPC manager Ian saying that I think it ill advised they move the car in the mean (tomorrow at the latest) time due to the unsure nature over the land ownership. He also let slip that they will not load the cars onto the softloader if it is unsafe to do so, either damage to the cars, their lorry or men. This would result in the clamps being removed and the men leaving without further action. ;) So I have removed some wheels and suspension strut top bolts, along with subframe nuts and engine mounts and left signs in the car explaining their rather unsafe nature. I haven't had a reply from Ian at NPC with regards to email from Edin city council. I did phone him but was told he was now in a meeting. Seemed to have clamped though..

Have to phone in morning to find out what happened. Try my manager for a second day off.

It's likely that one of the clauses in that will cover tidyness, cars etc within the common area. I would guess that someone has asked for something to be done about it.
 
One of the things about Scotland that we can be at least a little proud of is that theft and extortion by clampers is illegal. This really annoys me.

Rightly or wrongly where's the issue? The cars are parked up and off the road. It's not like they're burnt out or anything like that.

edit: Maybe if they've been there for ages then I could see a problem.

in what way do untaxed cars look messier than taxed ones ?

Generally if a car is not moved for a period of time it will degrade in condition, weeds will grow around it, it'll get covered in that weird algea stuff and just generally start to look abandoned.

Some people's car's look like that anyway, saw a Vectra in my works car park yesterday that looked like it belonged in a scrap yard (even more than your average Vectra)
 
I don't want to read the whole thread, but that would be rudiculously easy to cut off, you could do it with a hand saw with a tungsten steel blade. Angle grinder would be overkill.
