Fraudulent Claim Against Us

Hi Guys,

I think this is my first time posting in Motors so be gentle.

Right on Tuesday just gone, my wife came with my little girl to pick me up from work. On the way home we went past a shop driving down a double lane one way street. At the bottom there is a 2 way street which is rarely at this particular junction in use by cars.

Now the incident in question:

The car in front of us was an Audi A6 Navy Blue with an Asian guy in the seat and a little lad in the back (aged between 5 and 8) with no restraints/seatbelts/carseat/booster seat etc. Now at this junction as i said is hardly busy. Now this guy "went" to go then all of a sudden slammed on his brakes and our car went into the back of his at no more than 5mph, there was 150^10% nothing coming period. So we obviously got out of our cars and i went straight to the front of ours to survey the "damage" i went to the back of his car and instantly noticed a little scuff possibly 3-5inches long and a similar mark on ours. Then there was about a hands width above it an indentation that looked like it had been done with a sharp object.

The guy in broken English came and looked and tapped by this mark and said "you did this" to which i said "no we've done that" and pointed at the scuff. We asked for his details to which he went in the car and started getting a pen.

This is where it gets interesting...

From just around the corner came a couple who when passing looked in the driver seat at him fathing and made the comment "Oh, its him again"... to which we instantly jumped on "again?, what do you mean again?" and the guy and his partner told us how the same man, in the same car had done this only two-three weeks prior to another driver. I instantly got on the phone to the police to request a squad car and an ambulance just to check my daughter over. Meanwhile my wife took down the phone number of the guy and his address and he said he'd be happy being a witness if it was needed.

At this point he then gets on the phone and says he is calling his cousin as he doesn't speak good English. My wife double checked he was OK and his Son (still scampering round the back) was OK, to which the guy said "Yes".

A few minutes later a Taxi pulls up and out steps this other Asian driver and proceeds to walk towards the "forward" party. My wife went up as he was walking and said "Are you his cousin" to which he looked, ignored/said nothing and went up and started having a short conversation in another language, then said "Yes, i'm his cousin" (as though he had to corroborate that he was with the other guy). We exchanged details etc and when the ambulance driver arrived he said that this was quite common and an incident had happened not too far away.

After explaining the story to Police and saying that something didn't add up as:
1) He was trying to claim for old damage
2) We have two witnesses who said he did it before a few weeks ago
3) He called his cousin who wrote down his details for him

Now after having my daughter checked at A&E and speaking to a friend of my wifes (who used to work in insurance namely Motor Vehicle) she told us to be very, very careful of the situation as she has known some pretty striking stories which she said "involves a threat from Solicitors the next day and also trying to claim for only injuries claimed and nothing for the vehicle (Remember this quote).

Now fast forward to Wednesday (yesterday) my wife receives a call from a Hasim Qasim of B***** (iirc) Solicitors on "behalf" of my client. He informed us he had ran a check and we hadn't any insurance... strange how we have. After my wife told him this he began asking for her details, DOB, Home Phone, Insurance details, amounts etc. My wife promptly refused saying you have all the details you need in knowing who our Insurance is with and also our Contact details, at this point he became in my wife's words quite agressive first demanding, then threatening action, fines, lawsuits, getting her arrested etc. After realising he wasnt getting anywhere he then said that he would be logging on their system we are "refusing" to co-operate, my wife just said "put whatever you want" and hung up. We called the PC dealing with it and informed her of the threatening nature of the call and she has made a log of it.

Later that day, my wife took our car in to the main dealer near to where we got it and explained what had happened. To her shock, the mechanic asked "It wasnt by any chance an Asian driving the front car" and told how another woman had brought in her... lets say Punto with a very similar story to ours.

Now final one for Wednesday we called this witness and he explained what had happened on the previous occasion the driver had done this and he explained that prior to this (in the same place again) the driver upon impacting in the back of his car got out and became (according to him) very abusive and threatening asking why he'd braked etc and the Asian guy had just "drove" off (obviously realising he wasn't going to get anywhere). We called the Insurer again to tell them what had gone on and this story to which my wife hadn't even finishedsaying their name B.. when she was overspoke by the guy "B******" she said "Yes" and he said it doesn't surprise him and they are apparently "on the radar" of a lot of Insurance firms as ones to watch out for. She explained what had gone on and they told us not to worry.

Today

*Sigh* today we received a letter from B***** which lol i couldn't believe, saying that they were writing on behalf of Axxxx Axxxxxx of xxxxx and that they are proceeding to sue us for whiplash and ligament and muscle damage to his spine.... we were shocked the car wasn't going 5mph!

It then went on to say that failure to reply to this letter would result in further penalties being added and should we not reply "they will have no choice" but to instruct "specialists: A Sami, Q Ibrahim (?) and A Talik (?) to write a full report of Axxxx Axxxxx's conditions.

I've spoken to my mate who works for a very large Insurance Broker and he has infomed me not to worry as, so long as our witnesses are prepared to give evidence we should be OK, and in addition to this (my mate being quite a wily one) said that should it come to court to print off a list of Theory Test questions, which if the party cannot read or make out it will either void his case or at the very least make a jury very questionative of the situation.

I'm just wanting any similar stories or advice that can be given or if there are any specialist agencies (which need to be free as we aren't exactly Rockefellers).

***Note am in a rush and may have forgot some minor details and i may change a few parts if i remember anything else

Forward the letter to your insurance company, they will do everything.

These asians sound like a bunch of scammers.
 
Hope it all goes your way and the 3rd party gets what is coming to him. I suppose its a bit different to the usual 22 people in the car claiming whiplash.
 
I'd get legal advice rather than listening to your "wily" mate's suggestion of printing off theory test questions. You also won't be appearing in front of a jury.
 
Some people will do anything to claim and get money, just forward the letter to your insurance company and then leave it. ^^

No offense to anyone but no surprise really :rolleyes:
 
We really can't believe whats happening though and how its so straight cut and dry, the Police just seem to be *shrug*
 
Why were you following the guy so close that you couldn't stop before going into the back of him? :confused:

Typical roundabout/junction crash.

Its clear so you see the car in front starts to move, you look right to see if you are OK to go and then look back to see your about to impact into the back of the car in front as its stopped for no reason.
 
it won't go anywhere, it's a shame you feel this concerned.

Think about the damage to the car then think about the 'injuries', I think the other party have a lot more to worry about legally than you.
 
you have less than 1% chance of preventing them from claiming against your insurance. the burden of proof for proving fraud is seriously high and for the value of the claim, your insurer will never be able to justify the cost of trying to do so.

get over it and move on. its one of 100s of similar claims that happen everyday. ive worked on files where thousands were spend on low impact injury reports trying to show how much force would have been transferred to the car in front... but it doesnt matter, you touched their car, you cant do anything about someone being prone to injury... other than not driving into them
 
Why were you following the guy so close that you couldn't stop before going into the back of him?

Even if we were 10ft clear he braked so hard and so suddenly i doubt Hamilton would have had any chance tbh

Thats what i keep getting told... can't help but keep thinking i should drive our other car and wait by his street and then do the same back to him and get out holding out neck etc and sue against his insurer...

Probably has no insurance, just the 'solicitor' which you'd probably get stuffed by. :/

try it, an almost sure fire route to a little "compo". the country is rife with it unfortunately. my gf was caught out by something similar last year. you cannot be too careful, it was just bad luck

anyway, i take it youre insured, so your insurer will take the hit? after that all youve got ot lose is some NCB, if its not protected. so its not the end of the world
 
The funniest thing about this incident is the highlighting of the fact that these scammers were Asian. Unfortunately scammers come in all flavours, black, white, yellow, clearly asian and everything in between.

As Matt82 said, unfortunately these ***wipes are going to get away with it, withlittle that you can do about it. In reality of course they should all be shot, regardless of their colour!
