Exactly, everyone markets their tracks, if they throw RATM for that then everyone else would have to follow

The X-Factor groups are only in response to the RATM situation. Based on the wording in the thread quoted earlier, I would say that RATM should be disqualified. That's in my interpretation of the rules, and not in my personal opinion (I don't believe they should be disqualified).

The RATM record would not have achieved anywhere near the chart position it did without the support behind it that had the sole intention of distorting the chart.
 
I was more on about the free gig if they win.
As much as Xfactor IS a distortion, it's indirect in the sense they're not pushing it in your face like Morello was with the gig.

As I said, only if this is correct:

No record company, distributor, retailer, Artist or other party should act or encourage others to act in any
way designed to distort, or which has the effect of distorting the Chart by achieving a higher or lower Chart
position for a record than it would otherwise achieve.
