20th Century fox vs Newzbin

I know legal costs can be very expensive but what level of legal protection could they get? Apparently their 2009 turnover was £1m, profits being £360,000 and i guess they have earned a fair bit more prior to that.

If you look at the judgement from point 60 onwards as described above its a no brainer to see why they lost. It looks like the prosecution lawyers really nailed this guy.

Did we really expect this to go any other way? You don't pay a sub to Newzbin so you can find your unix distros easier.

I think that really clears up exactly what was going on in the case, and exactly why they lost... Because they were doing exactly what they were accused of, facilitating, managing and aiding copyright infringement.

Yeah all along their news posts made out they had a great defense but it seems to come down to.

NZB: "Most of our indexing isn't Binary or copyrighted material"

Prosecution: "Yes it is, here's the stats"

NZB: "But we don't know that users are going to actually download the illegal stuff"

Prosecution: "Here's logs where you answered support queries specifically regarding downloading illegal stuff"

NZB: "... >.<"

Have you read the judgement? It appears they didn't have much of a leg to stand on.

Still doesn't mean it cant be a stupid outcome.

If only the Tv and music people actually had an ounce of sense between them and realised that they are overcharging massively for their products then maybe piracy could be reduced, but until then long live newsgroups!

It is silly people download it because they want it the same time as america. We dont want it months behind everyone else its a farce.

I only don't understand why they go after the users rather than the providers itself. I mean why don't they sue Virgin Media for their free Usenet access for all their customers. There are many huge companies providing all this for us for free or with some sort of subscription.

If both CD's and DVD's were £1 each people would still download for the price of their Usenet connection.
Let's see - 12 month unlimited downloading subs to Newshosting for £80 where £80 = 80 CD's or DVD's doing it legally.
Hmm, wonder which most would go for?

Because usenet is very legal.

From what I've been told, they'd probably have fared better had their defense solicitor not 1: twittered/blogged his way through the trial, talking about what happened & openly admitting downloading, then watching a movie and 2: not turned out to be (I believe) quite a large shareholder in Newzbin itself... Whoopsie.
