council parking ticket

Have 2 little hitlers driving smart cars around here, get your ticket in the post a few days later nice.

Times ive seen them taking pictures giving tickets why they sit on double yellow lines them selves.

This depends on who it is issuing the ticket.

If it is a council parking attendant then, to be valid, the ticket must be either handed to the driver or fixed to the vehicle. If you subsequently get a Notice to Owner you should write to the issuing council, explaining the situation, and ask for it to be cancelled. If they will not cancel it then appeal. Although the adjudication services do not categorise types of appeal anecdotal evidence suggests that between a third and a half of all appeals are for this reason.

According to the link it seems that if it is a police officer or traffic warden who is writing a ticket it will be sent to the registered keeper.
 
Basically you were damned if you did, and damned if you didn't.

If you pulled over and were on the phone with the engine on, you would have been committing an offense, and if the engine was off, you were parked.

Sounds like you got an absolute **** of a traffic warden, 99% of traffies in Brighton will just move you on if you park up on DL's.

That drives me up the wall, they always park outside my house (single yellow) to go off ticketing other people.

I complained to the council but they told me they are allowed to do that as it is part of their duty :rolleyes:

Sounds like he parked where he shouldnt have, was a gobby **** to the traffic warden so got a ticket.

I was gobby to him at all. He asked if I would move and I say 2 secs just sending a message then I will move. He said OK. I then finished and looked to move out but I was trapped in due to the massive line of traffic on the road so couldnt move out. He then told me to move, to which I replied where to theres traffic so I cant pull out. He then became an a*** towards me and started to write a ticket even though my engine was running.
Like I said I turned around and then parked up again on the double yellow to talk to them as the nearest parking place was up the road but the charge money just for entering and I had no cash apart from 7p so I couldnt park there and I didnt want to loose them. He walked off a little down the road and I got out my car and then he took another picture which is a bit drastic seem as I wanted to talk to him. Anyway we will see what happens if I have to pay then I will pay, if I dont then I wont.

I got gobby when he gave me the ticket after he said I should use my phone whilst Im driving.

It's up to the OP if he actually moves when he's given the opportunity.

I wasn't there, I cannot obviously say I saw what happened.
However I personally find it hard to believe that if you had the engine running, had put the phone down, were indicating and preparing to move into this heavy stream of traffic then he ticketed you.

Add in the fact you don't seem too fussed if you get the fine or not - again if I had my engine running and was attempting to merge into traffic and was given a ticket I would definitely be contesting it.
 
Thats why I am contesting it. I had no chace of moving due to the traffic. I cant remember if my indicator was on but I was definately looking around making eye contact with the other drivers to let me out. The only problem is, is that theres no witnesses just the 2 wardens.

This is relevant at all but one of the wardens was eastern european and the other was western. The eastern traffic warden was the person who issued me the fine. I think he couldnt see that there was traffic.

I think they were p***** off that all the other drivers had moved and formed a line of traffic and I was the unfourtunate person who got trapped in and they wanted to fine me.
 
If it really was as you described i'd appeal it until I was blue in the face - but given your history I think there's more to this than meets the eye.
 
Well thats what happened. There were loads of cars parked up on the yellows. So I pulled up as well thinking it was Ok to use my phone. Next thing that happened I know all the cars that parked up made a massive queue of traffic. I was still on my phone thinking that I was OK. The warden came told me to move. I said OK 2 secs let me finish sending this then I will move. He replied OK. At this point everything was fine. I couldnt move out. He then told me to move even though I couldnt apart from drive my car into the cars around me. He then started writting his ticket out. Blah blah blah and the rest is history.
 
I dont know how long I was there for. I was there before they came. I was then using my phone and then stuck waiting to pull out in traffic but 6 minutes is a long time if you think about it.

If you were not there for 6 minutes then he shouldn't have given you a ticket. all you have to do now is prove that. Itemised billing maybe?

I use to be a parking attendent and I use to let people off if then genuinley didnt know about things. I remember letting someone off for parking in a child bay because the child was over age that they had brought but they thought the age was up to 13.

I understand where you are coming from but I did think that it was Ok for me to stop on the yellows and use my phone. Plus it wasnt against the law to use your phone and drive at the time a was a parking attendent. Also I was an attendent in a car park not on the street, so I didnt know about the double yellows rule with mobiles. All I know is that you are not allowed to stop ie picking people up, dropping off, loading etc not that you are not allowed to leave your car there if you brake down or use your mobile.
 
TBH sounds like he gave you a chance... was that text so important? to put the phone aside and drive off and he'd have let you off... but no you had to ignore the fact you were in the wrong and make it worse... he wasn't saying "OK get it done then go" he was saying "OK {in his head}I gave him a chance now he deserves this ticket"

I was violating multiple rules, but I will appeal the fine.

Why would you not just pay the fine early to get the discount?
They wouldn't be siding with the parking attendant because they want your money. They'd be siding with them because it is the correct thing to do.

Ignorance isn't a decent enough defence.
