Traveling to US with conviction

One of my bosses got done for GBH, went inside for 3 weeks. This was back in 2008. Been to the US at least a dozen times since then. How do they find out?
 
I went to the states in 2005, I never declared my convictions on the wavier form you fill out on the plane, and passed through customs with no issues.

My mate who came with us, he has done bird in the past and did declare his convictions, he had to go into a seperate room, 20 mins later he came out and was let into the country.

Not sure what its like now a days though. But just ask youself it is really worth the gamble???
 
Last time I went to the States, in the visa form you fill-in on the plane I only remember them asking for very specific convictions i.e. have you been linked to terrorism, prosecuted for possession or smuggling of illegal drugs, any association with being a Nazi! That sort of high level thing, I don’t remember them having a box for plain old ‘Do you have any convictions’. This was a Florida trip in January on Virgin Atlantic. ...I could be wrong though :cool:
 
Just remember that US customs have NO access to the UK criminal database.
If you are suspected of drugs or terrorism then you're on a speperate "watch out for" list.
However US customs cannot scan in your passport and see any criminal records - in effect when they scan in your passport they are checking you against their own database.
If they don't have any intelligence on you then you'll get in fine.
 
This has prompted me into doing some research on the subject, it seems that the embassies will tell you that you need a visa for everything, and since they cost £100+ for 1 years travel they stand to make a packet.

The actual legal requirements are somewhat different, you are only ineligable if you have commited a crime of moral turpitude or drugs offences. Helpfully they list the crimes of moral turpitude here: http://www.state.gov/documents/organization/86942.pdf .

However ABH is not Moral Turpitude according to that link.

It doesn't actually say Actual Bodily Harm but it says assault is one and then broken into 4-5 types of different assault.

I'm no lawyer/solicitor so have no clue in this subject, more interested to know really. It seems that crimes involving Moral Turpitude are crimes that involve "inherently evil" motives.

Anyone know the difference between assault and ABH? I would have thought ABH is on the higher end of assault as it involves actually causing harm to a person that has physical evidence to back it up?

My money is on him getting in. When I turned up in LA they were suspicious about why I had loads of stamps for going in and out of thailand from laos, along with stamps for fiji, newzealand and australia. They looked at my bag and said in his strong american accent "is that all you got"

They are not happy wen they find out you have a conviction. A mate of mine got of the airport at florida and they literally bollocked him for lying.

Yes they can find out if u lied!

Literally bollocked him? I have visions of a giant claw and a very painful deportation...
 
just did some digging and it appears he has another conviction for credit card fraud on top of his ABH one but that was way back in 2001/2002 so maybe its gone off his record

if he gets in i will be really ****** off

he is my mate and all but he always gets away with everything its unreal
