What is the legal definition of "littering"?

"Defacement" is pretty subjective, no?

For littering to be complete, you need to prove a person:
  • threw down/droppped/disposited litter
  • in a place open to the air in an area of a 'principal litter authoriy' (council controlled) or public place
  • and left it there

If you can prove that then the offence is complete.
 
Ok, so you parked where you shouldn't have, tore up a notice and threw it on the floor, got caught by an off-duty PCSO and issued an FPN, argued about it until 3 police officers turned up, then threw the rest of it on the floor once they left.

He had a non unformed "employee" for Thames Valley Police
(wasn't an officer as far as I can tell as he didn't have a warrant card, just a plain card that said he is an "employee of TVP) - which makes me think it was just another PCSO who figured he'd "act" as an officer to make me not get them to call some more out
(which I did, I got them to call some proper police out of who 3 turned up lol)

are you for real? people might not like the police but im sure they have better things to do than deal with people like you on a matter which a PCSO can sort out :rolleyes:

I'd have told him to go do one and that whilst removing the item on my car, my secondary objective was to clean up but hadn't got around to it yet.

I'd have argue semantics till his/her face was blue, I can see that if I dropped (for example) a packet of crisps and walked off, fine I understand that. But if I dropped it, ignored it for a moment to do something more pressing then picked it up, how can they prove you wrong? They can't.

Under the whole principle, I'd have refused, cleaned it up and driven off and he would have zero proof.

Refuse what? I wouldn't argue with you. I'd let you argue with the magistrate instead.

Refused a fine based on something they assumed I had commited.
This statement is based on the example that I was in the OPs position but would clean up the mess.

If you still believe in your reply after knowing what you know now, it's no wonder why people get a bit agitated or angry when someone wrongly accuses you of doing something and then fines you for it!

I don't litter myself, it makes me just as angry that people cannot simply use their hands to place an object in a bin :(

So for me in my imaginary situation would not be a happy chappy at all, so yeah maybe I would still have to argue my case with the magistrate, but it's insulting to me to have to pay for something I didn't do. Do you understand?

Same principle, yes it happened but I am going to clean it up, but not on some pre-defined schedule by some wannabe-police officer.
We don't fully understand the OPs situation and people are jumping to conclusions, but it is his fault for not clearly explaining.

As if leaving biodegradable material on the ground is so much worse than putting it into a bin that then need to be emptied and transported to be dumped on the ground somewhere else.

Most of these replies are hilarious. OCUK forums need a makeover, with all the old ladies in here faffing on about littering they should swap out the gangster theme and install something a bit more appropriate, like care bears.

rypt: I'd pay the fine in cash, with five thousand and five hundred one pennies, just to make them feel special.

I sure you would love us all to come over to your house and dump all our biodegradable waste in it for you to see, they used to do that in the old days, along with wee and poo, bet the streets looked and smelled nice, but dont worry it will rot down in a few weeks.
