Speeding - little help please.

I was caught doing 61 in a 40 by radar a few weeks back , court summons is in 3 weeks time, was just after a bit of advice. Hands up, im a ****, learnt my lesson this time. I currently have 3 points, and was wondering if anybody has been in a similar situation? From what others have said to me so far, im under the impression i should be expecting at least 6 points and a £500 fine, and on a bad day, a possible ban? Would it be advised to bring my boss with me on the day to appeal for commuting, or is this sorted after the hearing?

How long have you had your license?

Mags guidelines are 4-6 points or a 7 - 28 day ban, plus a fine of up to £1000

There is no advice really - we all do it, we all take the punishment, next time if you are going to do near motorway speeds in 40 zones at least keep your eyes open for speed cameras or cops. Or any of the other hazards in a 40 zone which you'd have also missed :p

Hmm never heard of that.

Depending how far over the limit determines punishment. Doesn't matter how long you have had your license does it?

after that its 12.

If he'd been driving less than 2 years, and already had 3 points, another would have taken him to 6, thus he needs to be seen by a magistrates instead as offering him 3 points would ban him.

But he's had his license more than 2 years, so should in theory be able to have 6 points no problem. And they dont start sending you to court till at least 25mph over the limit, so given he was only doing 21, its quite strange.

The officer said he could not deal with the offence road side and it would have to be forwarded to the magistrates court for a hearing.

It was a country road, small 40mph section in between two 60's. Early morning, no cars on the road, the bugger got me coming round a long sweeping corner from 200 meters away in an unmarked 1 series :(
 
Have just been reading up on this, and apparently i should have been asked if i wanted a conditional offer of fixed penalty which is 3 points and a £60 fine for the speed i was doing in the posted 40mph restriction?

Page 6 specificily states that for a 40mph limit, the guidelines say only to summons at 66mph and above

However if you look at the magistrates sentencing guidelines

Says that at 61mph or over (:( for the op) you are ellible for 4-6 points or 7 -28 day ban.

So the police officer is entitled to refer the person to the magistrates, but APCO "guidelines" say not to both unless its 66mph or above.

Considering you have to be doing 61 or above, to refer to the magistrate, the copper has been an absolute ****.

I've actually been lucky with being given only 3 points in the past I guess. It really does depend on how the copper is feeling when he/she pulls you over, I've had some really canny and talk to you like a human coppers and some "you are scum" types :(
 
Well this is tomorrow morning, fingers crossed, but really not expecting good news. I am fearing for the worse, then hopefully I might be pleasantly surprised (6 points, £750 fine).

I'm finding it hard to think of what to say, as you have to be so careful what words you say because the ******** might make the penalty even worse. (for example saying "I know i was driving recklessly" ...."recklessly aye? banned!") :p
 
If it all goes boss eyed chin a copper in the court and get your moneys worth :)
