Speeding - little help please.

Well this is tomorrow morning, fingers crossed, but really not expecting good news. I am fearing for the worse, then hopefully I might be pleasantly surprised (6 points, £750 fine).

I'm finding it hard to think of what to say, as you have to be so careful what words you say because the ******** might make the penalty even worse. (for example saying "I know i was driving recklessly" ...."recklessly aye? banned!") :p

from my experience when i was caught doing 107 - dont try and worm out of it. just admit that you knew you've done wrong and that you've learned your lesson.

I wouldnt mention anything about the fact the copper who referred you for doing 21mph over the limit could only just refer you, 1 mph less and you could have had a fixed penalty and all that, as it will just seem like sour grapes (although perfectly true :D )

Refer to the magistrates as "your worships" and make sure you A) turn up on time and B) wear a suit and tie.

Do everything you can to subliminally convince them of your good character by having a shave and looking well turned out etc...

I'd also mention any mitigating circumstances

For mine i mentioned that the motorway was quiet being 1am, and that the stretch in question was downhill, so with no other drives on the road to gauge my speed and not looking at my speedo, it got higher than i would normally go.

I thought the probation period was 2 years? So you shouldn't lose your licence under that rule.

I'd put a lot of money on you getting 5 points as from memory what I read up on before I had to go to court for 100 in a 70, up to 10 over 3, up to 20 over 4, up to 30 over 5, more than 30 over and you get 6/ban, more than 40 over they start throwing Dangerous Driving at you. I got 5 points and a £150 fine, £35 costs and an annoying loading on my insurance for the next 5 years!

To be honest I'd just plead guilty by post. If they're considering banning you (which I severely doubt) they'll invite you in.

Seriously don't try to justify what you were doing at all. Just say it was stupid, you have realised how immature and naive you were and this was the wake-up call you needed to alter your driving style.

Oh trust me, i'm not trying to justify it. I'm just hoping, like anyone in this situation, that i could get the minimum penalty possible.

Magistrates only banned for 28 days (maximum is 56) and gave me a £70 fine so they didnt see it that way.

They agreed with me. If you had your eyes on the speedo you wouldnt have them on the road !

No, but for doing 21mph over the limit the magistrates CAN give you a short term ban. Look here at the magistrates guidelines

I didnt try to justify, just explained how it happened. I deliberately said "it happened because ..."

depends if the Magistrates take the hump with him. They threw the book at mark and gave him everything they could.

No idea what he did to cheese them off but the OP would do well to do the exact opposite :D

It was a while since I read that thread, but from what I remember he went in there with a lawyer and tried to justify why what he was doing was perfectly safe?
