Alright guys im coming off a roundabout to go onto the A500 and some old guy has pulled right out on me. I had to swerve to avoid him but he managed to git my back end.

No whiplash or any of that crap its totally that guys fault but he wont admit liability.

I have one witness, problem is he works for insurance brooker and wants me to do the claim through his solicitors (just my luck)

He said its an easy case and i should go doctors to claim (i said i was fine, i wont do that ) He also wanted me to have a hire car ASAP obviously he can screw the insurance company out of more money.

Problem if i dont go through him he wont be a witness for me. Now with the other driver not admiting it was his fault would would you do?

Witness is a right tool for a start, you go with whoever you want to go with...ie the person you're claiming from's insurance company, not some random third party solicitor.

I know but do you think without a witness i might get screwed in this? Im 21 so really cant afford to lose my no claims
 
So he actually said that unless you went with his company, he wouldn't be a witness for you?

You have to be very careful here, as if it goes 50/50 you end up with the bill for your over-inflated hire costs etc.

What exactly has the other driver said, regarding fault?

He basically said that but not directly. I dont think i will bother with a hire car.


EDIT: oh apparently he wont admit anything as it was my fault. Despite being in the lane to exit a roundabout and him pulling out in front of me.
 
could you give some more details on how this happened? im having trouble picturing it in my head, both cars look to have O/S damage from the pics was he tying to go the wrong way round the roundabout or something?

*EDIT* nvm wasn't looking at door handle properly thought it was front wing damage

From the damage its pretty conclusive what happened, you must have been in the zone first (and had right of way) or his damage would have been further back and yours more forward.

Utterly disgusting behaviour by witness. Sounds like you have no choice but to go through him. I am shocked people behave like this? Unreal
 
got a pic from google maps or something? how did he hit that part of you if you were pulling off the roundabout? You would have exited before the point he pulls out, or was he pulling out from an exit prior to the exit you were making?
 
So he is black mailing you?

Is there any way this could be turned back around and you getting the blame? If it is a clear cut decision I wouldnt bother with this tool.

What is the guy in the other car saying? What is his excuse?
 
If the other driver knows he was a witness then can't you both get your insurance companies to write to him and as I'm aware if he is a witness then he has to comply with their investigations.

What's the worst he could do? You have photos of the incident so if his story doesn't match what you and the pictures say then the insurance co will see this and void his statement.

The guy is clearly a tool, and is only thinking of his commission for the work.

I think it's pretty apparent that OP was indicating for the next exit, whilst passing the exit prior to his. Other driver pulls out into path of OP.

I'm guessing that is what is happening, but if that was the case how can the other driver really think that he is not at fault?

The same way every scumbag on the road tries to weasel out of everything that they don't really want to be associated with.

Guy is probably a douche.
 
Annoying as it is I'd play happy and go through the witness. At the end of the day getting the car fixed and everything back to normal is No1 so if you have to smilie and do whatever to get the witness to play ball then do it.
