Is this how MM works (ie MM rules broken)?

So I wanted to buy a copy of World Of Warcraft Cataclysm from AtaRo.

I see j.col offering AtaRo £20 but he refuses as this is too low for him. So I offered AtaRo the money he would accept for it. I wait and wait and wait and then I see that the sale is completed. I check the feedback and I see that j.col got it so I assume he must have offered a higher price but not through the forum but via email.

Was this move against the MM rules?
 
They may have decided it over e-mail?
He must have accepted the other offer or a modified version of it. Can't see how it would go against the rules and I wouldn't say those rules are broken.
 
I read the rules the same as the OP. Once a set price has been agreed upon it can't be trumped by someone else. Its not a auction site and I would think the mod team don't want to have to end up policing it such.

Just buy it from somebody / somewhere else.
 
I have sold over 100 items on members market, and my motto is whoever posts first and matches the asking price, its theirs.

If that deal falls through, then I offer it to the next person in line who asks for it.

It's the only fair way, its not an auction forum
 
It's not because I didn't get it, it's the principle of it, if someone offers you the price you want you sell it to that person you don't go behind someone's back to get an extra £1.
 
So the first guy offered below the amount, but you then matched his asking price but it still goes to the other guy?
 
2.2.5 - A SELLER can sell to who ever he/she wishes.

Bad form to not let you know that it has been sold but I don't think the rules have been broken.

Actually thats incorrect. Just because he posted first doesnt mean he gets first choice.

However it is up to the seller to choose who he wants to sell to.

But in this case, there was a buyer who was willing to purchase the product at asking, which was more than the original offer.

So it does look a bit dubious as to how come the seller sold his product to the guy who was offering less money (one explanation could be that they took the deal to email).
But I think at the end of the day, the fundamental rule is, the seller decides who to sell to and I dont think any rules we're broken per se, but just bad form on the sellers part.
 
As far as i understand it the rules state that the seller can sell to whomever they like and also that there's no 'line' to speak of.

I've seen may threads where someone makes an offer, another member offers asking and the seller gives first refusal to the person that made the initial interested offer.

It varies depending on the seller and circumstances - it just happens.

I've both lost out and gained in equal measure accross many sales, it tends to average out but it's ultimately up to the seller as to who they sell to.

i always favour someone who has purchased from me before as its a better chance of getting a smooth deal
 
TBH policing minor things like this on the members market would be a huge and taxing task as they cannot stop people from taking the odd deal through e-mail. And the time could be much policing real problem deals or rule breakers.

Although I would frown apon this as people have said, its bad form and doesnt happen a lot, I would just say take it on the chin and move on.

Regarding the below, for all we know they stuck to the price agreed in the thread. That's all they have to say in order to get away scot free.

If he had sold it via email, then yes he is technically breaking Members Market rules.

Rule 2.2.7 -

2.2.7 - If you wish to place a firm offer to buy an item, please post in the thread. Offers by MSN/Email are not acceptable. This is to prevent disputes. However, requests to split items or swaps must still be kept to email. Once a BUYER has made an offer, he/she must not edit that post. If the BUYER wishes to change the offer, he/she must do so in a NEW post. Editing of an existing offer with intent to deceive the SELLER by appearing to have the higher offer first will result in a suspension.

It's a bit late for me to do anything about it now though.
 
Glad you posted that Maccy as i thought it was alright to offer via email. My thinking was take it straight to email to avoid making a mistake in M&M & getting Sussed.

I just read it again & I was Ok as I offered for something amongst a split.
