If they are weighed and priced at the tills then yes she was stealing.

Eh? I bought one banana in Tesco earlier today.

It's stealing in my eyes. Having a biscuit from a packet is slightly different as they aren't individually priced by weight but I wouldn't do that either but have seen parents do it to pacify their brats.
 
To my left right now is a guide written by one of the local plods regarding shoplifting. Its one of those numonics (sp), so bear with me.

SCONE
Selection - You must witness the person select the item
Concealment - You must witness the person conceal the item
Observation - You must watch them at all times to ensure they haven't replaced the item elsewhere (obviously not possible when she's eaten the damn thing)
Non Payment - You must see them avoid any reasonable attempts to pay for the item (again, eating it if its a weighed item)
Exit - Finally you must watch them exit the store, with the item on them not having made any attempt to pay for said item.
 
Actually, I took a bottle of Evian from a pack of six I had in the trolley on Friday whilst queuing at the checkout and took a drink from it!

she is claiming, that all she had to do is weight the bunch of bananas she had brought to the till, then remove one and pay again for this, therfore paying for the eaten banana, ;)
But wouldn't you have to measure the banana to make sure its comparable? :p:p
 
i sometimes get a cold drink for walking around, while doing weekly shop, thing is it will always be priced the same even if it was opened, with bananas i think if the are loose there is a price per lb/kg, which means u are avoiding the full payment, sorta like stealing
 
and yet these grazers are often the same people that would be appalled if they saw a rat snacking on the crumbs fallen from their 'I've no willpower' snack.

seriously, until you've bought it it's not yours, no doubt she's grossly exaggerated the story.
 
Unless she doesnt intend to pay its not really theft. Cant see a problem with it personally as long as she does pay and it doesnt cause any extra work for the staff. Not something i'd do though.
 
By doing what? Trying to decipher how much of her stool weight is from the banana?

That's not the point...the weight or the price is of no relevance in terms of the test when it comes to theft.

What is relevant is whether you were dishonest.

No it doesn't. The full facts aren't known therefore it would be foolish to state if it is theft or not in a legal sense. That is why I said in my eyes. I don't believe that she had any intention to pay for the banana in the end and thus was dishonest in depriving the owner (Tesco) of having ownership of the banana. I could make this stick, Sheriff.

Are you on a training contract, or just started your studies?
 
Are people really saying that in order to facilitate the theft of a banana, the woman got a trolley, shopped in the store under the reuse of shopping in order to steal one single banana?

If she walked out of the store without paying I would say that it is theft, however if at the checkout she told the Till Operator to add it on then no, it's not theft.
 
Just to clear it up.
It was a banana removed from a bunch, that had to be weighed

I do that ALL the time, i can't eat a bunch, so I snap off 1 and buy that for the day.

The til asks how many I got, I put in 1, put in change in the machine.
