Is this shop lifting?

Personal opinion to legal opinion are like apples and oranges.

And? We don't have the full facts of the case so it's all just guess work to entertain us. I'm quite aware of what the law says about theft :rolleyes:. Like I said, I doubt that she had any intention of paying for the banana and upon leaving the shop the theft would have taken place.

I actually also think that she threatened the other bananas on the bunch with force if they didn't relinquish control of the single banana. I'd have her up for robbery.
 
The tesco express near me has a touch screen icon for the number of bananas you have, so as Raymond, i enter 1 etc...
But i have had to weigh them before at other stores,
I think the point is, that in that store its done by weight, and if she has eaten it, then you can't weigh it

So are you saying she goes in and do a trolley full of shopping and try to cheat the supermarket out of 30p or something?

If you are in the jury, and that comes to court, would that be believable to you?

i don't need to, the software and hardware is universally the same and unlike a clove of garlic, or a pepper, or a grapefruit or a melon loose bananas are priced by weight (like loose apples and oranges and mushrooms).

end of discussion, sure it's not asking how many bags you reused? or are you even in sainsburys?

I once got a major sneezing fit in the supermarket and opened a pack of tissues that I'd put in my trolley, to use one of them. I still paid for them - I can't imagine anyone who works in my local Tesco would care about it. I thought it was only shoplifting once you tried to leave the premises without having paid?

But yeah, her eating an item that is sold by weight is a no-no IMO. But an over-reaction by the security guard - just weigh the biggest banana there and charge her for it?
 
I've done this once with a bottle of water, but I did run in choking on the sandwich I had been eating, and as soon as the water had done it's job, I went and apologised about doing it, and then paid.

I didn't really feel like I had time to go and queue up and pay in that situation, I still got horrible looks from the staff, though.

I wouldn't be sitting on a jury for a case like this.
 
No idea why people are arguing semantics of law when the guard's employer has agreed with the guard therefore he has followed the guidelines that the guard's employer has stipulated when it comes to people eating food they have not yet paid for.
 
Where did I side step it? A case like this wouldn't appear in the Courts before a jury so why ask such a pointless question?

I would actually. You must be shopping at the newer convenience stores because they're the only ones that do it differently, or so I'm informed.

Irrespective most civilized people accept that, unlike a restaurant, it's not yours to eat till you've paid for it.
