Been Clamped - Is it still legal?

Hi

Woke up to find my car clamped this morning in a private car park, I have a designated space but it was full so left it out of the way.

Anyway, I just want confirmation if clamping is still legal in England as there was talk of banning it last year.

I can't get the damn thing off so looks like I've got no choice but to pay. :mad:
 
No chance you can pop the wishbone out?

It's still "legal" as afaik, so you'll have to send the small claims court stuff to the clamping firm and the site management company.
 
Angle grinder. Destroy all traces of clamp.

Unless there is CCTV.

Hold on, if it's your place can you not just phone up the clamping company and have them remove it?
 
Assuming it's not a council clamp...

It's actually cheapest to cut the clamp off and then buy them a new one. That's if you want to be morally correct.

Alternatively, cut it off and throw in the nearest river.
 
Believe me it was very tempting to cut the thing off but thought better of it as it's not exactly hard for them to find my car is it.

Tried taking the wheel off but no luck the chain was around the axle, so had to call them out.

He reduced it to £80 from £130 as I was a resident but still, one damn expensive space for a night.

I spoke to the police as well and they told me that the ban hasn't gone through yet, although he did say to contact the landowners to see if they can work something out. However that was easier said than done as 4 different apartment blocks use the car park and in the end they said "tough" pretty much.

All in all one damn annoying day and in future I will call the clampers out to anyone using my space, I thought it was a bit petty for one night as we have no visitor spaces but obviously other residents take it upon themselves to be arses.
 
Silverstone camp site for formula student was fun this year. Last year you could park next to your tent, not this year. Security came round when our transit box van was there, "oi, you're gonna have to move that or we'll lift it!" "What with?" "We've got the lifts they use for the F1 cars." (worst lie ever) "An F1 car weighs ~600KG, this is a fully loaded 3.5 ton box van with a lathe in the back..."

They did have a wagon, it wansn't the forklift they use for the F1 cars, and it couldn't pick up the van due to it being too tall.
 
I don't think enforcing the use of your allocated parking space is being an arse.

I wasn't in a space though, I parked completely out of the way but someone still called it in.

In the past I've let people off using my space but from now on I'll have to be an arse as well.
 
Hang on a minute... they clamp your car and charge you money because they can't do their job properly and keep your space free for you? WTF!?

I would sue them for dereliction of duty or whatever it's called :S
 
Firm comes to clamp someone in your space.

Said person refuses to pay

You lose your space until they do

You get clamped for not parking in your allocated space.


Clamping makes no sense here :/

That's good of him :rolleyes: What a scumbag.

I have to agree with hurfdurf....if there's no CCTV, why not just cut the clamp off and deny all knowledge? Seems like they'd have a hard time proving what you did if it came to court.
