While reading this:

I was surprised to hear that Steven Gough (the 'naked rambler') has " been behind bars in Scotland for much of the past decade.", seemingly exclusively due to his penchant for airing his balls in public. I previously had no idea that walking around outside with no clothes on was such a serious offence that it could get you 21 month prison terms - as far as I can see, being naked doesn't harm anybody, and unless you're making threatening advances on someone else while naked or something (which doesn't appear to have happened in this case), I can't really see the harm in getting naked in public. Anyway, prison certainly doesn't seem to have changed this guys mind, so I wonder what good it really does locking him up, spending countless thousands on him, just so that other people don't get the opportunity to admire the human form.

Another aspect that seems unfair is that there don't seem to be any hard and fast guidelines on what is acceptable, which means if you fancy going outside and getting the maximum possible vitamin D dose while doing the shopping, there is no way to predict what will actually land you in jail, and what will merely cause some awkward conversation with the cashier. (I really wonder what the limit is - would he have been arrested if he covered the end of his willy with a finger puppet? or would a G-string be more appropriate?) It seems a bit unfair that the judgement by someone else.

Anyway, I was just very surprised that in this supposedly 'free' country you can't walk down the high street or into court in your birthday suit without incurring what seems to me to be a very lengthy sentence. After all, as the ancient saying goes, 'we've all got one!' (or at least half of us do, and I'm sure most of the other half will have seen a willy before anyway).

There's only a few days of the year where it's possible without freezing your nob off, so I'm not really too bothered. Leave him be.

yeah it's almost as if he was convicted of something else too isn't like say contempt of court and that he was having to finish the last part of his previous sentence (remember we let people out early, but if they do something wrong again in that time they go back to jail for the rest.)

but yeah go down the local primary school at home time and get your tackle out I'm sure the parents at the gate will support your freedoms.

it would be more of an argument if our climate suited being nude to get the maximum cooling benifit, or allergies to cotton or polyestor etc. doubt he has none of that and is just being a nob.

Well I for one am glad I can go out without having to have someone's tackle in my face.

Op is so fall of fail. Of course there are sentencing guidelines and law.

using nudity to "harass, alarm or distress" others is an offence against the Public Order Act of 1986.

Under the Sexual Offences Act 2003 it is not an offence to be naked in public in England and Wales. It becomes an offence if it can be proved the person stripped off with the intention to cause distress, alarm or outrage.
Then they run the risk of three possible offences, says a spokesman for law firm Kingsley Napley. These are:
• Indecent exposure - an offence under section 66 of the Sexual Offences Act 2003
• Intentional harassment, alarm or distress under section 4A of the Public Order Act 1986
• "Outraging public decency" under common law

And he has got all that time for being nude, contempt of court and not first offence.

Did you actuall say anything correct in the OP.

Apparently Scotland is a lot stricter on this than England and Wales are.

Personally I find him eccentric but I think it is outrageous that he is being jailed for such a long time, ultimately for something which is not illegal. He clearly has no intent to offend and there is no sexual motive for his nudity.

Id imagine parents with their kids, wont appreciate a naked person walking by them.

Its their word against his, end of.

He did landsend to John o groats. 900mikes naked and was arrested 14times and over all those offences served a couple of weeks in jail. The vast amount of time is due to attempt of court and number of offences.

Of course he caused offence, it was in public places. It's not so much what he thought, but what can be considered to cause offence.
You don't need the soul intention to cause offence. But if you walk through a town, it is reasonable to expect that your actions will cause offence.

And what exactly have you been reading that says he didn't cause offence.
He was arrested several times, made several court appearances and served two jail sentences on his journey, following complaints from members of the public.

You misread what I said.

I said he didn't INTEND to cause offence. The law on public nudity is all about intent. The act of being naked in public is not illegal. His reason for being nude was because he felt comfortable that way, not because he wanted to offend people.

I accept that people WERE offended but that doesn't mean a crime was committed. Some people might be offended to see a woman in a very short skirt, or with tattoos, or a white girl with a black man. Lots of things offend people, but it's too bad.

So in a supposed liberal democracy we have a man who has committed no crime per se, who is spending as much time in prison as murderers. This is quite insane.
