Parking Ticket - please reassure my wife!

Short version:
Received a "Charge Notice" from parking company, I want to ignore it, wife worried.

Long version:
Couple of weeks ago, in the early evening, we were driving up the M40 when our car developed a fault. Not wanting to spend hours sitting in the dark on the hard shoulder we limped the mile or so to the Cherwell Valley services and called the AA.

Fast forward 4 hours the problem was fixed and we were on our way.

The car park had a 2 hour limit enforced by a parking firm and ANPR cameras. The guy in the petrol station took my reg and said he'd put it in the system so we wouldn't get a ticket. "Nice" I thought, but I'll believe it when I see it.

Sure enough today on the doormat lands a "charge notice" for £50/£80/£120 from a company called "CP Plus".



I'm all for completely ignoring it (not council, not police etc) and my conscious is clear as we were stuck there broken down, not taking advantage of some free parking while sleeping in the car.

My wife is a little worried that the bailiffs will be round for our first born.

Please reassure her!
 
I had one from the exact same company, they sent me three letters in total. All of which I of course ignored and have not heard anything from them for about 3 months now. The threats do increase dramatically but nothing comes of it.

As an aside I don't think it's taking advantage to sleep in one of those car parks, do we really want to be pushing tired drivers back out onto the roads? Which is what a lot of people would do rather then pay the £10 charge to stay longer then the maximum 2 hours.
 
It is an 'invoice' for the 'driver'.

They dont know who the driver is - only the registered keeper. S172 of the Road Traffic Act does not obligate you to tell them who the driver is.

Therefore.. the end.
 
i didnt bin mine, i framed them as i love photos of my car. Again, what is it with women wanting to pay "charges" (this is not a fine!). My Sister and my friend have both instantly paid up when one of these came through the post, and my mum was having a go at me for not wanting to pay for my charge... Wouldn't surprise me if she paid it for me and never told me!

They will send 3 letters tops then forget about you.
 
Exactly the same thing happened to me in march/april this year - same kind of camera system etc.

Suffice to say I binned the 'invoice', the second 'invoice', the 'reminder' and then the two letters from the 'debt' collection agency.

Nothing has ever come of it. It's not shown on my Equifax credit report.

Just as a thought - if I ever end up in a car park run by a company like this should I just not bother buying a ticket or paying for it, s they can't enforce it?

Luckily they DVLA hadn't updated their details (she had told them about the change of address) so the letters still go to the old address, (but letters from the DVLA still come to the new address, excellent). The last one from the parking ****ers was threatening court action, we don't get the letters very regularly, could they take her to court without her knowing and then **** up her credit rating?

It's very annoying.

They have to pay for the information and anyone with a "good reason" will be able to get the same details.

But as said the driver of the vehicle is the person who gets the invoice but the owner is under no obligation to name them.

Wont affect credit rating at all, they arent loaning her any money, they dont know who the driver is so they cannot enforce anything

I've had seven of these mate and all give you FINAL NOTICE which could lead to baliffs coming.

Only council can make you pay. Private companies can't enforce nothing.

They have a 4 letter cycle and as long as 98% cave in and pay, they don't care about the other 2%; not that they could do much anyway if they tried to pursue.

Had one (well, 3) from the exact same company when I stayed in a Travelodge at Frankley services. Ignored them and haven't heard anything for a couple of months now :)
 
if its a private company they don't stand a chance in court.

if I was you, I would call the company and tell them every thing in the OP, if they carry on sending you **** then go to the petrol station and have a 'word'.
 
I ignored one from years ago. Fed it to my dog and posted the pics IIRC. Never heard since.
