Hate to play devils advocate here but DRZ also broke the highway code if we're going down that route.
Section 166
DO NOT overtake if there is any doubt, or where you cannot see far enough ahead to be sure it is safe. For example, when you are approaching a corner or bend
^This one is subjective.
Section 167
DO NOT overtake where you might come into conflict with other road users. For example approaching or at a road junction on either side of the road
There is a clear junction at 1:53 during the overtake, if Ross was there driving with his side lights on and would have pulled out and turned left there would have been a head on. If I'm not mistaken, the OP should have pulled out to check that the road ahead was clear of junctions, and then pulled out once clear.
Like I said, devils advocate, we all know you can't really see a junction coming up in the dark unless someone is there with their lights on, but in the eyes of the law this doesn't matter.
Not slating, just posting my interpretation of the Highway Code. Don't shoot me.
