Ok so my girlfriend got hit by a bus while pulling out of a junction, it was clear on her side of the road but the bus had to get past some parked cars on his side of the road so came all the way onto hers, she thought the bus would stop when he saw she was half way out of the junction, it did not and carried on coming, girlfriend stopped, and the bus clipped her front bumper with his back end.

Bus company says its her fault, she says its his. This was back in november it happend, and since then it still has not been settled. so thats like 4-5 months since the incident, they are aparently waiting for CCTV footage the bus company say they have but they have not yet provided.

So my girlfriend is a new driver, has 0 no claims bonus and this would be her first, she has 10month policy which is due for renewal soon, obviously she would like to have the 1 years no claims in time for renewal if it goes her way, anyway she can speed things up? How long is she soposed to wait for the bus company to provide footage, thats if they even still have it surely the would have provided it by now?

She would also like to claim for damage to her car from the bus company, she is only third party so cant claim on her own, so is waiting to get the all clear for the damage to her car to be repaired.

I have to say, i'm really struggling to see how the bus could have hit her with the rear of the bus, as you've described events. Diagram please :p

Sorry but the bus had right of way, when pulling out onto any road it is the drivers responsibility to make sure it is safe. This is a common occurrence on the estate where my parents live as a transit parks opposite the junction.
 
I really can't see how the bus 'hit' her, especially when you say she made contact with the side/rear of the bus.

She was obviously pulling into a hazard and presuming the bus was going to stop. Patience or spacial awareness needed, you decide.
 
Whilst I can kind of visualise how the rear of the bus might have hit the front of her car - depending what kind of bus it was the back often swings out when turning - it still doesn't excuse the fact she shouldn't have pulled out when she could clearly see it coming, sounds like she tried to force her way out to get in front of the bus and he didn't give in.
 
Hi, maybe i didnt make it clear enough, my girlfriend had already gone into her side of the road coming out of the junction, the bus was not yet on her side of the road, she saw the bus coming and wasnt sure if it would stop or not, it carried on came onto her side of the road to pass the cars, she still didnt move at all and the bus carried on coming. i guess the bus must have went further onto her side of her road and not realised he had not passed my girlfriends car, and clipping her bumper with his rear end.

as far as i am aware, its the bus drivers fault, the road was clear on HER side, when she was pulling out, the road was not clear on the busses, the buss continued and hit my girlfriend who was already pulling out.

If their was a car coming the other side of the road and the bus hit it head on the other person would be at fault by that logic!
 
A.Why should it have done?
B.NEVER assume what another drivers action will be.

A. because his side of the road was not clear, and my girlfriend was half way pulling out of the junction before he attempted to move onto her side of the road. It was her right of way as far as i can tell?
B. thats why she did stop when it looked like he was going to come onto her side. He should have stopped as their clearly was not enough room to pass!

Plus, i dont know for sure, but isnt it ilegal to park oposite a junction like that?
 
Then I guess that's a bit more of a grey area.

Whilst technically traffic on the major road has right of way over traffic joining from a minor road (and it should have been obvious to your GF that the bus would need to move to her side of the road to pass the parked cars), at the same time, vehicles should also give way to oncoming traffic if they need to pass an obstruction on their side of the road.
 
plus my girlfriend did say in order to actually see down the road the bus was traveling on she would have needed to pull out of the junction a little to see the bus coming on the oposite side, so she didnt have much choice to come out a little anyway.

This was all written in her statement, plus Pictures sent, the bus driver has yet to provide a statement, or pictures, or the cctv footage they say they have, and time is running out for this years insurance renewal :(
 
It's hard to visualise. But large vehicles like buses take longer to stop. So she should allow extra space for them. While the bus had to pull onto her side of the road she should only turn into a road if it is clear. I'd say it's 50/50 at best and most likely to go fully against her I'm afraid.
